    They have provided a trail of how they got the hirer details, with NTH sent to 2 companies and then named me. I can’t see they have responded to hirer liability. 
      I note they have said “ the appellant has confirmed that they  were driving when contravention occurred and to e breach of terms and conditions were no adhered to”

    it then goes on to say I appealed it and it says I did not confirm or dispute that I was the driver on the day in question. 

    The landowner document is from 2017, attached below 
    Is this true, or have they *cough* misinterpreted what you said in your appeal?

    Please show us precisely what you put in your initial appeal.

    As for ECP's response to your PoPLA appeal, go through it and compare it point by point with your appeal. For any and every point that they have failed to address, state that the appeal must be allowed.

    100% they have misinterpreted what I said..
    my original appeal letter is this, 

    Reason For Appeal: I yam writing to appeal PCN number  as hirer of vehicle.
    Auxillis Ltd have passed the first notice to me via an administration charge and confirmed they have
    transferred liability to the vehicles hirer, but no Notice to Hirer has arrived. I am therefore disputing the
    charge and have seen no evidence of a breach or who was driving, so I require further evidence,
    images of the contract in the sign, close up ANPR images of all entries/exits by that car in that day, and a POPLA code.
    I am the Hirer / Lease


  • Is there any comments to be made on the landlord document?
  • I have until Friday to comment so would like to submit Thursday night.. any further help would be greatly appreciated.

    Just point this out to POPLA (that the operator is lying).

    Assuming there's a map/plan attached then POPLA will accept that document.

    So concentrate your comments ONLY on what I said.  Plus any observations that the £100 is tiny & hidden in small print on the signage pictures, and/or that the photos are irrelevant/old (if true).

    And there's one more possible comment (if true) if you look at the POPLA DECISIONS thread very near the end.  Someone posted a recent decision against ECP I think which was about the photos in the NTK being cropped.

    As you didn't receive all letters from PPC please consider supporting this.

    So many people don't receive 1st and/or 2nd pcn but the £170 payment due letter often manages to drop through letter boxes. PPCs always claim discounted rate/full rate pcns/court claim letters were sent as dated though they offer no evidence to prove this.

    Since they CHOOSE NOT to provide evidence of their posting we must continue to press gov to ensure they do and see it included in the new Parking CoP. Please sign/share @jmccabe petition closes 22nd june 2024
