So what have Leaseplan UK Ltd done about the Parking Charge Notice sent to them?
Look at option b) under the heading 'YOU ARE NOW INVITED TO:'.
Has Leaseplan UK Ltd done that? Until they do, then Leaseplan are still on the hook for any charge.
Remember that Leaseplan are in no position to nominate the driver. Leaseplan were not present at the parking event so cannot say who was driving at the time.2 -
Leaseplan have written to G24 advising that the car is on long term hire to us. They do not appear to have provided the info set out in the IAS decision. As such, to my mind, I should wait 21 days from Leaseplan's notification and, assuming I hear nothing from G24, appeal on the basis that POFA 2012, Schedule 4, para 14 has not been complied with.KeithP said:So what have Leaseplan UK Ltd done about the Parking Charge Notice sent to them?

Whilst they are not party to BPA code, I will also point out the minimum recommended grace period (10 mins) and refer to the fact that this was Christmas traffic at a retail park.
In addition, G24 set themselves out as the creditor. They do not own the land and are only managers of it. As such, unless the landowner has assigned the right the 'debt', they are not entitled to claim.

Almost certainly they will not include copies of the necessary hire documents, which in turn means they are unable to transfer any driver's liability to the keeper.
Then you refer again to those appeal templates at the bottom of the second post of the NEWBIES thread that I mentioned earlier.

Annoyingly, without express permission, the lease company has paid the charge.Their letter advises that they will refund this (together with admin fee) if I appeal and it is successful.The PCN company has not made contact with me and I’ve heard nothing from the lease company since the original notice.Any thoughts?
