Though, really, the OP does not want the car returned to them at all. In case that is seen by WBAC as some acceptance by the OP that they are getting the car back. It still creates the OP with a challenge / responsibility in terms of insurance etc. I would not want a car worth £36k or £46k sitting on my driveway without insurance.1 -
Hope the OP can update where the car is.
I would be surprised if WBAC did just drop it off without the OP's consent. I believe WBAC knowns it screwed up and is trying it on wit the OP.
IMHO WBAC currently own the car as contract is signed, the only way to get out of contract is by OP consent or via the courts. WBAC has a duty to look after the car while in it's care, so dumping it off somewhere wouldn't fulfil that.

I meant they tried to drop my car off so that’s me accepting their actions and a quick done at their end. I put the account on hold as soon as I found out they added a new owner to my logbook. That was the icing on the cake for me. I was going to reinsure and tax the car and accept until I found that out, even though I maybe shouldn’t be. When hearing about the keeper scenario on my logbook it really narked me and thought now you’re taking the ****. I have a transit van and I couldn’t car less about keepers etc but remember I still paid 44k for this car in May it counts for items like that. It’s unfair hence me being a stubborn such and such. I may loose this but I’ll give it my best shot.It’s certainly like a series on Netflix 😂1

How did you find out they 'added a new owner to your logbook'?
Log books have long gone, and nothing to do with owners anyway.
From what you have told us, you are still the registered keeper. When a dealer takes in a car they inform DVLA via their trader's portal. You remain the RK until the car is sold to the next private owner, but while in the custody of the motor trade the digital record of the vehicle has 'in trade' added on.
No new RK is added until either the dealer or the new buyer requests a new V5c.
You can see online when the RK last changed. What is the date there? I am willing to bet it was when you first bought the car.1 -
@Bmd1989 - can you please post up the letter(s)* that you sent to WBAC that CAB advised you on? I'd like to understand exactly what you said to them so I have some idea what WBAC are currently thinking about.
And have they responded directly to that/those letter(s) yet?
*A scan please or a copy and paste. Not just what you recall or think you recall telling them. Need to know exactly what you told them. (Don't want to be rude but I suspect English may not be your first language? Either that or the device you use to post here has a mind - or vocabulary - of its own...1 -
OP just one thought, if you reluctantly end up with the car back* and plan to sell privately you can buy insurance for short periods, whilst more expensive per day it might be cheaper to buy a 30 day policy than pay cancellation fees on a yearly policy.
*I don't think it's possible to force WBAC to pay**, as mentioned at the start of the thread you'd most likely be looking at selling again and claiming the short fall, plus any expenses in selling again, as damages.
**I know courts can award specific performance, I'm not sure under what circumstances but a quick Google suggests when it would award "more complete and perfect justice", as you are looking to sell the car and end up with £43k in your hand awarding money as damages rather than specific performance seems to do the job really.

If WBAC return the car and OP goes to court seek specific performance that may be declined, they'd then have to sell the car and go back to court a second time for any shortfall.
Far safer bet to resell and claim the difference.
Specific performance isn't an issue I've seen a thread on here covering so other than relying on Google I can't offer much advice on it which really means seeking professional advice (or someone else here may have the knowledge I don't)In the game of chess you can never let your adversary see your pieces0
