Safestyle problem

Ok I will make this question as brief as possible.
We bought windows and doors on credit.
We had them fitted before they went bust.
No problem with the fitting. 
The problem is that safestyle has not sent ghe information to fensa or the insurer who backs the garentee. 
As the 15 year garentee and fensa backed promise was all over the paperwork but not delivered would this mean I can claim back somthing with a section 75?

The stated purpose of Section 75 is to ensure credit card providers and loan companies are jointly liable for any breach of contract or misrepresentation by a retailer or trader. This extended to sellers, as well.

    Its not the stated purpose and when the legislation was drafted how credit worked was very different to how it is today but thats by the by.

    To claim something you would need to show you have suffered a financial loss as a consequence of the breach of contract... are you intending to sell up shortly? A guarantee only really gets a value if you resell it or need to claim on it. 

    Have you followed the process advised on https://www.fensa.org.uk/FENSA-Safestyle-FAQs-for-homeowners to try to get the docs?

    To be clear, are you wanting to claim something now, on the basis that you haven't got what you were sold?  Or are you talking about potential claims in the future, if you do encounter a problem?

    Who is the finance provider?  Have you explored what it would cost to buy the insurance-backed guarantee separately?  That would seem to be your loss.  Let's say that was £500 - surely you'd rather have the guarantee for 15 years than a relatively modest sum now that might not cover any problems you do have in the next 15 years?

    Have you spoken to FENSA about not receiving paperwork?

    S75 would not give you a payout now.

  • I have been in contact with fensa and the insurer both say "sorry can't help you"
    I even tried the email for safestyle enquiries attached with the liquidator (sounds like a cool name huh?) No one wants to help.
    I paid for windows and doors, fensa certificate and a 15 year guarantee. 
    I have only received the windows.

    Do you know what the cost is?  You can't claim an arbitrary amount and as born_again says, S75 isn't a route.

    You can buy a guarantee separately, so get some quotes.

    I purchased in 2004 a MG Z-TT  paying £200 deposit with bank credit card 
    Part of the original deal was 5 year parts and service warranty 
    2005 MG Rover went into administration,
    Claimed section 75 cover for remaining 4 year period   from bank.
    Bank arranged a third party parts and service warranty.at no cost to me  
  • I have contacted the insurers for safestyle asking for a price on the guarantee. Watch this space 🤪
  • Ok so I got a reply from the insurer. 

    We don’t provide the guarantee only the warranty insurance which covers the guarantee so if they’ve not provided the original guarantee we won’t have a policy to cover you.

     

    I have checked our records and can confirm that there is no policy of guarantee insurance in place with us to support the warranty originally provide to you by Safestyle UK.

     

    With this in mind, I am afraid we are unable to assist with any issues you are experiencing with this installation.
