    I think if sister lacks capacity it will be a Court of Protection Order, rather than PoA - I had to do one for my nan when she was in a home with dementia. More expensive and takes longer to sort than PoA :(

    Thats what was at the back of my head greent,  I knew there's something that takes ages and that must be what I half remembered.   I hoped it wouldn't be too much work to get it started then it could chunter away in the background for a couple of years.

    Thanks @greent  I have been reading and yes it would seem a court of protection order should be in place, however I also checked the will and the letter of wishes with it.  Now I know letter of wishes are expressions rather than legally binding but it seems VNM's mother wished VNM to "put aside" the house money until sister's death so that if sister needed anything it would be there for her, provided by him from this pot.   She wished him only to access the pot after sister's death.  (I think she wanted to provide a safety net for her daughter's housing and care but did not want to impact her current arrangements by leaving her the bulk of the estate).

    We can worry about the practicalities of this "wish" later.   In the short term then just getting the house sold is the thing for me to deal with since I have now checked that the accounts his mother opened in his sister's name have less than £10 in each.   So I will just let those go dormant as the effort to retrieve the small amount is not equal to the win for her.  It would seem the money she had put aside she moved into her own account and that has been used for the financial gifts she left in her will.

    In the event the proverbial hits the fan then co-habitees are better stashing their cash than being mortgage free !!
