3 CCJS, over 30 days. Also Default over 30 days

Hi Everyone, I have tried to read the newbie thread and can't find anyone with my problem. I am sorry if this already exists but there is so much information that I can't read everything as I have autism. I have 3 CCj's which are from BW legal, one from gladstone solicitors and one from DCBL. I have always been told to ignore private parking fines and these parking fines amount to thousands. I was never able to pay for these and now I don't drive the car anymore. Prior, I have tried to make payment arrangements but these never ended up working out. I really want to try and remove these ccj's as I dont want them to stay on my credit score for the next 6 years. I will do anything to remove these. Has anyone been in any situation like this? I need advice please

  • Were the original claims served at your correct address? If so, there is very little you can do about them and if they are all more than 30 days old, you are stuck with them on your credit file for the next 6 years. You could pay them but they will remain on your file but marked as "satisfied", which is not much better.

There is one option but it is risky and will cost you a not insignificant sum anyway. If the claims had a chance of being successfully defended, you could apply for a discretionary set aside under CPR 13.3. As mentioned though, it is a steep hill to climb.

Which PPC made the claim? BW Legal, Gladstones and DCB Legal are not the parking companies that made the claims. They are only the solicitors that acted for the PPCs.
  • Hi Jerry,

Thank you for responding. UK Car park management, Civil enforcement and Napier parking.

Do you think I have a leg to stand on if I tell them I can pay it in full to them? I have a nursery and flat which have similar addresses to me, I don't know if this is something they would consider?

The only way you can get the CCJs removed is if they are set aside. You can only get them set aside if a judge agrees that they were either served incorrectly (which, according to you, there were served to the correct address) or if you can prove that they have a good chance of being successfully defended. However, you will have to convince the court that you had a good excuse for not defending the claim in the first place (the steep hill you have to get over).

You could try and get some professional advice from a firm such as Contestor Legal Services who specialise in parking cases: https://www.contestorlegal.co.uk

Did you get the claim forms?

Do you qualify for Help with Court Fees?

  • I have the claim forms, what does qualifying for help with court fees mean? I also have two new ones issued by BW legal for £245 each, they said they are at the claim stage so I can pay these off and they wont issue a CCJ. But the other 3 I feel like I have no chance. I received a finance job and they are using hireright to do a background check on me, they said they will do a 'soft credit' check and i am not sure if my ccjs will come up it is stressing meout

  • I have 3 ccj's, and not sure whether to apply for consent order or for them to be set aside? I have a nursery and apartment complex with  the same address as me and not quite sure if they will take this into consideration? also about consent orders, when speaking to BW legal and gladstone they did say they have nothing to do with the CCJ and I should speak to the court? I am not sure if they are trying to have me on or just want to make things more complicated

Have you tried Contestor Legal yet?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
