Parking or Stopping?

  • Thank you.
I think I'd feel better by responding as you suggest using the template in the newbies faq.  I'm just a little confused about who to send it to since there are no actual solicitors involved (yet).

Should I write to NPE, who have sent the LBC or to CIS, even though previous advice has been to ignore anything from debt collectors?  or maybe both?  can it do any harm?

Use the response to an LoC in the second post of the Newbies and send it by email to: office@parkingprotection.co.uk

Only use the extra 30 day request if you really need it. It is not required in the vast majority of cases. If you don't need it then take that bit out.

Don't worry about whether the recipient of the email deletes it. How do you know whether the recipient of a postal letter doesn't decide to just shred it? At least with an email to their published email address can be proved to have been sent and received.
  • Just to clarify . . . what's 'LoC', it's not in the Newbie faqs list of acronyms.  Letter of Claim perhaps?  or just a typo?

Fair point about a recipient ignoring an email.

Also, I don't really need the 30 request because of needing debt advice, but why not ask to delay things nevertheless?  Can it do any harm?

    LOC = LBC = Letter of/Before Claim

It does no harm. All it does is prolong the process. If you're in no rush to bring it to conclusion, then by all means delay it. It has no effect on the eventual outcome.

We used to include it because it would allow for an SAR response to be received before a claim was issued. However, as most claims issued have such poor PoC and there is now a good appeal judgment that is persuasive, we don't advise requesting an SAR (if at all) until after a claim is issued. Hence, no need for the delay.
  • Thanks for the clarification.
I'm in no particular rush, just trying to be as awkward to them as possible ;)

As for a SAR, that was going to be my next question.  Would it do any harm to request a SAR even before they start formal court proceedings (if they do)?  Again, thinking of making them work for their money plus showing that I'm serious about defending any court action they might bring.

    Thoughts?

You don't want a SAR or any more information because they are going to screw up the claim by failing to fully show the cause of action in the particulars of claim. Let them make the mistakes.

You don't SAR the solicitors. You SAR the PPC. If you're dead set on requesting an SAR from the PPC, then don't do it until after a claim has been served.

Delaying them does not inconvenience them at all. The whole process is automatic, hence the term "roboclaim". They do this hundreds of times every day. It does not enter their intellectually malnourished conscience that you are being a thorn in their side. They only salivate at the prospect of the low-hanging fruit either capitulating or ignoring them for a default CCJ.

Yes it does you harm to get a SAR.  DO NOT do it. You want a nice vague claim!

  • OK, points taken.  No SAR yet.

But I feel I should write to them using the 'response to LBC' template in the newbie faq.  I can also inform them of a new address to use because my Royal Mail redirection is causing a week or so delay in my receiving their letters and I'm guessing that's not good if things really do progress to court.  Last letter was dated 24th may but I only received it on3rd June.

Incidentally, I found the online civil procedures protocol they referred to in their last letter.  If anyone is interested, it's the 'debt-pap.pdf' document listed on webpage https://www.justice.gov.uk/courts/procedure-rules/civil/protocol

    Yep we know the PAP.

And yes, respond to the LBC telling them to erase all other addresses except the one you are confirming to be correct in 2024.
