Just a query, if you request a cca from a dca does that mean you can't apply to get your charges back from the OC?
Got Halifax Classic to reduce my interest rate by 5% woohoo - 10/06/08 Thanks MSE!
    Another 3% shaved off 10/12/08
    ANOTHER 4 % June 09:beer:

No, tm - not at all.

But surely if yiu have disputed that you owe the money and that is agreed, how can they possibly give you the charges back for an account you are not accepting is yours? Is the the key to get the charges back first then requesta cca?

Hello everyone , Just had a light bulb moment !.....:j .. I,ve requested a signed copy of Consumer Credit Agreement from two collection agencies . Plus proof of assignment ,so i know that i,m paying the correct people . So far its been 3 weeks since they received by recorded delivery letters . They now have another 3 weeks until they are in breech of the C C ACT.
If everyone who was being pressurised by these agencies were to do the same , request CCA , the chances are they would be snowed under ! And the question is how many would they be able to produce? There are template letters available , so come on everyone , give it ago !!!!!!!! You will lose nothing and maybe end up better off . GOOD LUCK:T :j
I have still not received any enforceable CCA,s.

It would be a good idea if the banks wern't already geared up for this. Most will provide you with the details on time.
Facts are most have not !
  • I'm still awaiting an Adjudictor to be allocated to deal with the complaint I have lodged with the FOS over the documents Sainsburys have provided thus far. I have forwarded a letter from the Office of Fair Trading who back up everything I have to say on this.

At first the FOS said they, "Were not there to 'police' the banking network" yet when I forwarded the OFT letter, they suddenly became interested in tackling this matter.

I would certainly encourage anyone to contact the OFT advising them of any issues you have over CCA requests - they won't act on individual cases - but they will respond in writing telling you that they believe a firm not providing a CCA when requested with the full prescribed terms and conditions is acting unlawfully in seeking to pursue a debt. That can be something very useful to copy and fling in the faces of Banks, DCAs and the FOS.
Almost debt-free, but certainly even with the Banks!

No not really . Had phone calls to my mobile every day for a month , I refused to confirm my new address . The idiots were using old address even though a previous DCA had my new address, and had after a CCA request returned account to OC .
A new DCA comes out of woodwork every now and then , they just send copies of application form , I tell them to bog off .
