Hi nmnm - You, too, need to send the letter in the link I posted in my last post.

They haven't bothered me. Nobody has contacted me for a couple of years about this debt. The last I heard was when natwest said they had passed it to their DCA. I then received 2 letters in Spanish which I ignored but I did notice the debt was in euros with interest added.
I continued to pay reduced amount to natwest but recently thought I should sent the CCA request. Do you still think I should send the letter

You can, if you prefer, wait until the additional 30 days are up, by which time they will have committed a criminal offence, and then send the 'final' letter, which you will, again thanks to weller711, find on this link:

If they are not 'hassling' you, then it might be better to wait the extra 30 days.

hi rog and weller , thanks for your advice and letter links . I,m still waiting on one response, two days till the time limit expires. One DCA have return account to OC , no news from them .The first DCA have sent copy of a application form . I pointed this out to them ,and asked where on form did the applicant agree to the OC selling the account on to a third party . No response yet .

I haven't paid the DCA - only the original creditor. Am I still ok to send this letter

I was also going to continue paing the reduced amounts - is that alright or will it go against me in the future.

Who did you ask for the cca? If it was the dca, then my guess is that he could be 'bounty hunting' - i.e. trying to 'collect' on a no win - no fee basis. But that does not matter - he would still be legally obliged to provide the cca within the prescribed period.
The fact that you are paying the 'reduced payment' to the original creditor, would indicate, to me, that they are relatively 'happy' with this agreement and I would see no reason to stop that.
I think I would advise, however, that you request a full and up to date statement, from the OC, as those 'interest charges' are setting the alarm bells ringing. This may be just the dca's way of trying to squeeze yet more money out of you.

Got another letter from DCA in response to my letter telling them that they had not complied to my request for a CCA . They bought the account ,and say they are looking into it and have requested more imformation from the OC . I had paid some money to them ,but now I will report them and demand payments made to them are returned .

They should send you everything that they hold on file about your accounts, including transcripts of any telephone conversations, and details of how decisions relating to the account were made.
The last time that I made an SAR (Blackhorse Finance) the 'package' weighed nearly two kgs.

  • Oh my god! I took off the bit that says I'll pick the stuff up from the branch - they have to send it to Spain. I better check they don't put an extra charge on for that ;) and interest of course.
