Oh dear. Disaster... so sorry but you are likely to lose by not attending because that hands the floor to the Claimant to say whatever they want to the judge, unchallenged.

No you can't change the date without paying a three figure fee.

If this is one worth thousands I'd change your flight, personally. It's that important. Could cost you a small fortune.

Or quickly contact Contestor Legal (Google them & contact them online immediately) to see if they are able to send a barrister but this is very short notice now.

Hi all, just a quick update in case it helps anyone:

Because I wrote to the court more than 14 days before the hearing date, my hearing was vacated without any fee. The court only confirmed this two days before the scheduled hearing, but it was actioned.

Under the HMCTS fee guidance (EX50), no fee is payable for an application by consent for an adjournment if received at least 14 days before the hearing. So don’t be misled into thinking you’ll automatically have to pay a fee just to request a date change.

Hope that saves someone the stress (or ££).

There is nothing either good or bad but thinking makes it so.

That's good. Thank goodness! Does the court know about any other dates this Summer when you are unavailable?

I've not been given a tenancy agreement.  :s
This isn't directly related to the parking case, but did you ever get your tenancy agreement?
(I'm just tying up loose ends here.)

Yes, I included other dates, I don't want that happening again.

No, I know that I have a tenancy even without the paper and tbh I think the landlord has more to lose by not providing one than the tenant, but hey ho.

Just stepped out of court. All tickets dismissed and I got costs awarded.
    Thanks for all your help.
It was won on unclear signage, unable to tell who the contract is with.
Fabulous news! Well done. Costs too!

    ANOTHER ONE BITES THE DUST!

If you still have anger and the energy, jump straight in to do this Consultation before it closes on Friday:

FIGHTBACK ALERT - just days to go!

Please do the government's Public Consultation. We need every poster to complete this vital survey before the deadline. See this thread:

    https://forums.moneysavingexpert.com/discussion/6617396/parking-code-of-practice-consultation-now-extended-closes-friday-26th-september/p1

We understand that you may need some pointers. It looks laborious, we get that. It doesn't matter; no knowledge is needed except re your own experiences so you can call out a scam industry and you'll protect millions of motorists and help change the law.

I've written some guidance to help focus new posters on the issues. I've covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.

Ordinary people like you are falling victim to this scam over 18 million times per annum. Motorists need your voice added please.

    CLOSES THIS FRIDAY.

For inspiration read the Which? response they've just published:

    https://www.which.co.uk/policy-and-insight/article/private-parking-code-of-practice-which-response-aMnXo1g7Dr2F

They mention residential cases where there is completely and utterly inadequate protection of authorised residents against these parking vultures with 'permit schemes' no resident needs or voted for.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
