    Good. Your para 5.4 surely kills the claim by Elite! The HA have torpedoed Elite's standing.

    You need to change 'appendix' to the more usual exhibit numbers (your initials followed by a number).

    The case law such as Hancock v Promontoria, Fairlie v Fenton and Jopson V Homeguard should be shown as URLs to assist the Judge (to the actual transcripts).

    Your statement of truth is 4 years out of date see the NEWBIES thread.

    Is this whole document under 50 pages? It must be or the court will throw it back.

    It appears to me that this case echoes Parkingeye v Somerfield stores . They were guilty of tort of deceit for what appears to the same reason the debt was owed to Somerfield not Parkingeye  , this was not challenged at the CoA.

    I was 8 minutes late getting it in and sent to every email address I could find for the court it wasn't on the notification of hearing where I expected to find it :/

    You must serve a copy of the same to the claimant or their legal representative’s email address given on their direction questionnaire forms or back to the same email address if they have served you a copy of their WS .

    I just called the court and the fee has been paid, so I have to assume it is going ahead. The court date is on the 9th June and I will be out of the country (I hadn't realised). Is there anyway to get the date changed?
    I have now been given a parking space, even though I was previously told I couldn't have one while this 'debt' remained in place, and the reason given for the delay when I signed for it was that the member of staff who deals with parking was absent for a year.

    Oh dear. Disaster... so sorry but you are likely to lose by not attending because that hands the floor to the Claimant to say whatever they want to the judge, unchallenged.

    No you can't change the date without paying a three figure fee.

    If this is one worth thousands I'd change your flight, personally. It's that important. Could cost you a small fortune.

    Or quickly contact Contestor Legal (Google them & contact them online immediately) to see if they are able to send a barrister but this is very short notice now.
