Debt collector - help please
Comments
-
They are required to put the case on hold if you state that whilst you deny the debt, you are seeking debt advice. Normally you would add to this that you require the case to be put on hold for 30 days as per court pre-action protocol.
They don't have to put the case on hold if you complain.
You can either send the 30 day hold instruction, or
Send a robust response to the LBC, or,
Ignore it and wait for the claim itself to arrive.

Thanks Coupon-mad.
Shall I send SAR to PPC at this stage as I have no details of how/why it's £160 charge which seems a lot as if I understand well it should not be this much? To add more details to the response letter to debt collector?
Thanks again0 -
No, don't send an SAR until after you receive a court claim.
You are not responding to a debt collector, you are responding to a solicitor, if that's the option you want to choose. They are two completely different entities.
Do not give them the opportunity to make a definitive claim. You want a vague one that doesn't give specific reasons for the claim so you can then respond with the Chan case in your defence.

In my complaint to PPC I did requested my case to be put on hold whilst seeking legal advice and instructed them to ask debt collectors to put it on hold too as PPC are instructing CST and if I were to receive any correspondence that I would consider it as harassment.Fruitcake said:They are required to put the case on hold if you state that whilst you deny the debt, you are seeking debt advice. the Chan case? this is getting too complicated for me :-)Fruitcake said:No, don't send an SAR until after you receive a court claim.

But did you state you were seeking DEBT advice? If not, they don't have to put the case on hold.
See what others say, but personally I would send a 30 day hold instruction then wait to make sure you don't ask then something that causes them to send a definitive claim.
A vague POC would be something like, the driver breached the terms displayed on signage at the site.
A specific claim would be something like, the driver failed to pay for parking, or parked outside a marked bay, or exceeded the permitted parking time, as displayed on signage at the site.
You want the former, not the latter.I married my cousin. I had to...I don't have a sister.

I have learnt my lesson with CAB, hence me seeking help here :-)Coupon-mad said:kit001 said:In my complaint to PPC I did requested my case to be put on hold whilst seeking legal advice and instructed them to ask debt collectors to put it on hold too as PPC are instructing CST and if I were to receive any correspondence that I would consider it as harassment. But that was daft advice from the CAB. Looking at those two robust answers in the NEWBIE thread, I am not sure how to adapt those two examples as I don't have the details of any potential additional cost (as I never got PCN's) nor about not being the driver (pofa example).
I appreciate that you see this quite a lot and I really appreciate the time you're taking to reply to me.
I would not be posting so much if it was crystal clear to me and do apologies if this sound redundant to you.
I am clearly struggling with these kind of processes (to find the matching answer in these threads linking to my case) and you have loads of experience that you are sharing, I would really appreciate if you could pin point out what not to write or what to write linking to my case.
Thanks again for your time.0 -
Either example would do. You quoted two.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Evening all,
First, I would like to thank you for pointing out to me direction for my case.
I have been and still going though the CST law thread.
I am preparing a a response to send to CST.
I just wanted to ask: the letter of CST says that : 'I have failed to settle the amount owed to PPC' whilst I actually did contact PPC. Is it something you would challenge in the response?
Also, would you challenge the amount as I have read many threads that £160 is excessive?
Something I forgot to mention, prior getting that LBC letter, I had a another letter asking to respond within 7 days (as seen on other threads)... When received, that would mean I only had 1 day to respond... Something to challenge?
I also found some email address for cst/credit style ... Anyone to confirm they got a response after emailing those? Or should I sent a letter on the safe side?
Thanks again for your support.0
