Be careful about what you are asking for.
A delay of thirty days will see a Claim Form drop through your letter-box a few days before Christmas.

Ah, ok. I assumed there'd be a bit of back and forth. Better get it over with. Thanks
  • Too polite!

No 'Thankyou' for an aggressive threatogram...

No 'please accept'.  They have to!

And it's 'principal' sum (not 'le').

Ha! Ok noted. Gone too far the other way :D

I normally suggest people finish emails to this lot by referring to the response given in Arkell v Pressdram.  ... Not joking!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Had to look that up, obviously... brave... and hilarious! :D:#
  • Right, last draft hopefully and then I'll send in the next day or so. Can anyone confirm that the email addresses I see dotted around @dcblegal.co.uk, paul, danielle, info are still good? I haven't seen anything super up to date for them.

    ____________________________

I acknowledge reciept of your letter dated 30th October 2023 and confirm that my address for service is:

    [Redacted]

The constitutes a formal response to Letter Before Claim.

First, the debt is disputed and any court proceedings will be vigorously defended.

Second, I will be seeking independent debt advice, but have no need of additional time in which to do this.

Third, I note that the amount being claimed has increased from £100 to £170. Am I to understand that the additional £70 represents a DRA, and if so, is this nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

Fourth, with regard to the principle sum claimed (£100). Is this damages, or will it be pleaded as consideration for parking?

Finally, may I take this opportunity to remind you that I have, on several occasions made more than reasonable efforts to contact your client and resoive this dispute, well in advance of any proposed legal procedings. All such efforts have been ignored.  As such I can see little in the way of good faith or legitimate interest in this action.

    Yours faithfully

Principal not principle in this context.

Sorry, missed that one from before. I've actually corrected it in my offline copy. Thanks

Ok... then how can the additional £70 possibly represent a Debt Recovery Agent?

I think you are missing the word 'fee'.
