Hi all, any ideas on my last question: Any ideas of timing now for the local court allocation and when can I expect the request for the WS?
Thank you as always for the help on this "nightmare"0 -

Thank you for the info. Noted. So now basically to wait for the local court to contact - I understand there is no need to inform them again of new dates I might not be available for the court hearing right? Also what happens or how can I inform them if I have some new days I might not be available?
I inform in my N180 of some of the days, but something came up in the company and I might need to be away some other days.
Thanks for the tips!1 -
Send a revised N180 (and copy in DCB Legal). Follow the process and you'll never have to worry about a court hearing attendance. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thank you Umkomaas for the reply. I need to be confirmed if this new trip might actually happen in the end and if so then I will be sending the updated N180. As meditation is over, I suppose I will need to work in my WS, but only when the court date has been assigned correct?0

Put in the dates (and a couple of added days before and after) even if they're not yet confirmed. You will need to submit your WS as per instructions in the Notice of Allocation - typically 14 days before the hearing date (but check the letter carefully as an earlier submission can be required by some courts). Please note, we are not a legal advice forum. Hi guys, got some further news earlier this week, I got a letter from the CNBC, for the Transfer of Proceedings, however I'm kind of socked and possibly it's just me not understanding the issue, so hopefully you can clarify: far from allocating to my local court, they've transferred this to St Helens County Court - near Liverpool??? This is actually close to the Claimants address? Or to be exact their layers? Will they reallocate afterwards or something?
Just socked because this is 6 hours driving away from where I live, which means that I would have to book hotels, train tickets or drive there, take days off etc, just completely out of the area that might be local to me???
Any ideas? Can I write to them or ask for them to reconsider?
Thank you!

Interesting... had exactly the same issue with a claim I'm assisting with where the defendant lives in Norfolk but the claim has been sent to St Helens county court.
Re: Norwich Traffic Control PCN - Unauthorised Parking - St Anne's Quarter, Norwich
I suspect there is a rogue numpty working at the CNCB who is clueless and allocating the claims to DCB Legal's nearby court. Whilst Warrington County Court would be their closest, St Helens County Court can be considered local as it is only about 13 miles from their offices.Under CPR 26.2A(2):
“A claim which is to be allocated to the small claims track will be transferred to the defendant’s home court if the defendant is an individual.”

Thank you for the comment, so I should follow the same procedure as per the link you share and immediately raise this issue to the CNCB correct? I'm preparing the email to both the CNCB and the St helens court right now. Do I need to copy also the claimant or there is no need?1

I do hope this is looked into ASAP, because it would be really messed up if I have to then be attending a court 600kms away from my local area, can this be challenged in any possible way??1
