McDonalds Wisemore O.P. Got Me As Well!

Hi!

I have just received one of Ocean Parking's £100 Penalty Charge Notices in the post today over parking there from 9.05 to 9.40 on Saturday the 4th November 2023!

As with all the other posters on the Forum regarding these parasites, the signage is impossible to read, furthermore I couldn't see any notice on McD's Door that tells you to register on a special tablet the staff there keep either!

I have not been able to drive my car for over three years due to eye–surgery, and therefore all driving has to be done by my friend Steve!

Please could you outline the steps I can take, and whether I should pay the "reduced penalty of £60" please?

The date of issue of the notice is the 8th, by the way!

We ate in this McDonalds and either my friend Steve or myself can provide the online banking transaction!

How do I appeal through the POPLA scheme?

It is clear that both McDonalds have not acted in accordance with their planning permission, nor have Ocean Parking adhered to the Code Of Practice regarding clear signage and highlighting when and how to pay, or register where limited free parking is permitted!

It is only from Reading This Forum afterwards that I found out you have to pester the staff for the Parking Registration Tablet!

Plan A in the NEWBIE sticky,  which I assume you have read, is to complain to McDonalds.

All actions required to get you underway on this are contained in the first post of the NEWBIES FAQ Announcement, on the first page of this forum's thread index - one of the first five sticky 'Announcements'. The thread is there with all the information needed, because the forum would be overwhelmed if we had to type out the detail for every newbie, the majority, will, like you, have had no previous experience of dealing with private parking charges.

Grab a cuppa and some biscuits and start going through it.  Make notes as you progress. Come back if anything is not clear.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Could you please help us by adding a front & back photo of the (your data redacted) NTK here:
    https://forums.moneysavingexpert.com/discussion/6483542/a-thread-of-pictures-of-2023-parking-firm-ntks/p1

Thanks!  Also we don't have a recent Ocean Parking one and it could be that we'd spot a POFA wording failure so it's in your interests.

  • I received this £100 Reminder Notice in today's post this morning!

Can your Experts confirm whether it is a Correctly Worded Notice To Keeper, and if so, is it time to submit my appeal to Popla please?

  • . . .I had received nothing else between the first letter dated 8 November and a complaint to McDonalds got nowhere – they insisted they didn't have a "Parking Registration Tablet" there and couldn't do anything about it, or so they claim – is it possible to send McD a complaint in writing and if so, who do I address it to?
  • First sentence should have said :–

". . .I had received nothing else between the first letter dated 8 November and the one received today and a complaint to McDonalds got nowhere –

. . .There doesn't seem to be an "edit" facility to correct mistakes in posts here!

There is but not until you reach a two digit post count!  You'll see 3 dots above your posts and you can then edit them.

Compare your NTK to the Ocean Parking ones in the NTK pictures thread that I started.  One is POFA compliant and one isn't. You'll see!  No link given because we don't do that here (to encourage new posters to learn how the forum works best) and it's one of my recent threads so you can find it in my profile.

It's taken you nearly a month to come back here after @coupon-mad asked you for more information!
Here is a case just like yours at the same location that was killed at POPLA:

  • I had no NTK or other document, letter or letter from Ocean Parking until today and so there was nothing I could have added to my post dated 10 November I'm afraid!

Wasn't the request made in a post on your thread on 10 November at 5:49PM good enough?
