Thanks. Re their WS then nothing that isn’t already catered for I don’t think. It’s quite straight forward
insofar that they rely on ANPR and a legal right to pursue the keeper plus what they say is clear signage. It’s not ideal as dad says the car was probably there but neither he nor mum who also drives were aware of any restrictions. He binned all the original letters thinking they were a scam (he’s been scammed before) I only happened to be visiting one day and the claim form was on the table else I’m sure he’d have binned that too.0 -
But surely their photos of signs are undated or old, and almost certainly show cluttered blue/yellow signs with £100 not "in big"?
Dad is meant to shoot down their evidence. Look again. I wasn't saying read their crap!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They’re dated but from three years prior to the date of alleged offence, which I have mentioned in the WS.I have visited the site and there are signs. The maximum stay is pretty big and bold but the penalty is not. On this point I’m not sure if including my own photos helps or hinders the defence. Given the burden or proof is on the claimant I’m not sure if it’s just best to say the photos are three years old and therefore the burden is not met (?)
I’ve included 31 - 33 re the signage.0 -
The £100 has to be prominent.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Okay. I’ll gather some images this evening and then add/update with a view to sending tomorrow. I got the claimants hard copy but presumably it’s okay to email?0

Struggling to find Excel v Wilkinson judgement. Searched forum and can find it cited everywhere but not an actual file I can add as exhibit.0

I’ve made the suggested amends and included comparison images as suggested so hopefully good to go tomorrow…
