I'd just add here:
5. The Defendant picked an unmarked/unsigned car park space to park the car, head to reception to drop off the keys and leave the area. This took mere minutes and (as defined in the similar and persuasive parking firm Appeal case of Jopson v Homeguard, heard by HHJ Harris QC at Oxford County Court) was brief unloading as opposed to 'parking'. No contractual signs or terms were seen nor agreed. The Claimant is put to strict proof of all allegations, save that it is admitted that the Defendant was the registered keeper and driver.

Just received an e-mail from Gladstones.Should I settle?Without Prejudice Save as to Costs
Dear xxxx,
We act for the Claimant.
We write further to your Defence and to receiving our Client's instructions in respect of the above case.
Our client is prepared to settle and offers £100.00 in full and final settlement of the claim. This settlement would include your agreement not to seek further costs from the Claimant given that costs were reserved at the previous hearing.
Please kindly confirm in writing whether you accept the above offer.
EDIT: Actually I want to settle...I do not want to wait until June 2025 myself to get this done and finally close this freaking case.0 -
NO!!!!
Email back and tell you wont be settling and that you intend to win this in court
etc etc etc2 -
Hold on, skimread the letter first time, but to be clear:
Are they going to pay me £100 so we can both shake hands and move on, or they are asking me to pay £100 to settle the case?1 -

Email back, giving them your bank details, and confirm that you are happy to settle accept their offer of them paying you £100 to end the case.
What costs were reserved from "the previous case"? Have you paid out a fee to set aside a CCJ for which they are still liable?Jenni x5 -

Yes, I have paid the fee and the CCJ costs have been reserved. Win the case, and they will have to pay me.
The downside of all this is that I have to wait until 25th June 2025 for this to end.
I already waited almost a year to get my CCJ aside, now I have to wait another year.0
