Bw Legal is threatening court action now. Also GXS Services reply (quoted in my first message) stated they have instructed bw to do so. Im looking for constructive next steps if anyone can help. Best,

No mention on this thread earlier of a Letter of Claim or Letter Before Claim which was dated in July 2023.

I recommend this, URGENT FOR TOMORROW:

Ring BW Legal up tomorrow, and IMPORTANT! - RECORD THE CALL ON ANOTHER PHONE - which is the ONLY reason I'm suggesting you call.

Do not do it without recording the call.

You are doing this to gather evidence for your case and to email to the Government.

Stay polite and calm. Keep the moral high ground.

Tell BW Legal that this is a case about a 0 or O VRM digit difference, which is not an error at all.  Tell them that GXS are aware of this and clearly this should have been cancelled earlier.  Tell them that you have researched keying errors and even Will Hurley of the IPC went on record saying that parking firms "must not marginalise motorists over a 0 or O difference". 

Put the first phone on loudspeaker and record the call on another phone, (EXCEPT for the moment when you give your name and address and reference from their letter).

Do not get upset or agree to pay.

NOT EVEN IF THEY THREATEN A COURT CLAIM AND NOT EVEN IF THEY SAY THEY HAVE ALREADY LODGED A COURT CLAIM.

Do not be misled or scared by them threatening court but ask them to explain why the case is still being pursued and can they resolve it and cancel it now, because keying error cases will not succeed in court and you will NOT be paying.  Tell them you will only pay if a Judge tells you to.  Be polite throughout.

PLEASE do this... it will also help your case.

IMPORTANT -

THE PHONE CALL RECORDING AND YOUR EVIDENCE OF GXS REFUSING TO CANCEL THE PCN MUST BE EMAILED TO THE GOVERNMENT BEFORE SUNDAY AT THE LATEST.

Please add to the Government's current Call For Evidence by sending an email to the DLUHC with your letters and phone call recording.

Prove to the Government that BW Legal are bullying you and refusing to resolve this case (IF THEY DO...let's see) and refusing to cancel the proposed court claim.

The Government want to hear from consumers as well as PPCs and Question 4 is the one to answer:

The advice seems to be to do nothing or contact the land owner. I am struggling to see how this strengthens my position. Again, apologies i am trying my best to follow this thread.

I couldn't help but laugh at this as you are right, it is most probably a new way to waste my time. I was thinking to see if i could raise a complaint, in the hope of having some discussion with them.

Yes. We advised wo options. Landowners can cancel PCNs.

But you read this advice then said you were going to do something else:
