  • Note everything. There is no "template" for a POPLA appeal. Just read the Newbies/FAQ thread where there is advice on what to include in a POPLA appeal. Also, do a search for recent POPLA appeals that have been successful. There are many on the forum. Also, there is a dedicated POPLA appeal thread which you can use to your advantage.

    Hi guys i have finally drafted my popla appeal. I have used the 26 page template referenced in the newbies section. Its not a total copy and paste as i have tried to adapt it to my own situation. Please please please review and advise on any subtractions or revisions as i am a total noob to this and dont really know what im doing. I have used my main argument posts as no signs present, differentiating between private and public land, and contradictions on the NtK and appeal rejection letter as one states the vehicle entered a car park and the rejection says the vehicle was in an area where no waitinf or parking is allowed. 

    have a read i know its long but please let me know if this is a decent appeal

    Suggest you look at recent POPLA appeals as the one you are using is obviously an old version.

    Also you should be using/quoting the BPA CoP version 8 (latest)  -  the paras you quoted do not agree with this V8.

    And make sure the appeal fits your particular circumstances.

    Thanks for letting me know. I’m looking on the popla decisions thread but can’t seem to find a full popla appeal as they are just decisions marked successful and unsuccessful and summaries. Can you point me to a link which provides the latest info in a popla appeal? Also apart from the usage of old information was the appeal sufficient? Did I cover everything I need to?

    Post 3 of the NEWBIES has a number of links to PoPLA appeal points that can be used. These include, but are not limited to,

    Not the landowner 
    No standing to issue charges in their own name
    Non PoFA compliant NTK
    BPA CoP failures
    Inadequate signage
    Anything else relevant

    Hi fruitcake thanks for the reply. Yeah I have been forming my appeal according to post 3 and have used the templates for Land owner authority grace periods inadequate signage etc but as grandad stated the bpa code of conduct was updated with version 8 so I don’t know if templates have now become obsolete with old information

    You can use the older templates but just make sure that if you refer to a CoP (either BPA or IPC) that you refer to the version in play at the time of your event

    Hi guys thanks for your help. So i have updated the appeal with the new code of practice version 8. mostly impacted the grace period side of things. They have made it a little harder for us but still can use this to appeal with. Here is the updated version guys please let me know if its good to go? I really wanna beat this and hopefully add this to the successful popla decisions archive!

    Yes that’s right so as I understand, upon entry of a car park and deciding whether to park and comply with Parking there is a consideration period that is a minimum of 5 minutes and when your parking period expires there is a grace period of a minimum of 10 minutes before a pcn can be enforced. Are you referring to the 1) heading in my appeal that states grace period only? Should I ammend this to include consideration and grace periods? I just assumed it would fall under the one heading
