  • Thanks mate. Should I mention anything regarding evidence to prove that the vehicle was parked on a private road and simply hanging up a sign saying private road is not good enough? Also they should provide evidence showing the boundary between what is private and public highway? Do you recommend I add or take away anything from the template?

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

  • Guys quick one before I submit the appeal. It’s asking for appellant details should I use my own name for this? Even though in the template it says as the ‘registered keeper’ will they not use this as admission and also the reason for the appeal I have put there was no signs displayed at the location indicating any restrictions. Is this ok?

    Of course you must use your own name. Who else's name were you thinking of using?

  • Sorry guys what I meant was apart from the statement, which I have used the template exactly as it has been laid out in blue, there is a separate tab which asks reason for appeal. Out of the options displayed I clicked on ‘there were no signs displayed which indicate any restrictions’ I just wanted to find out if this is the right option to click. Sorry for the confusion

    Hi guys back again. So after submitting a first stage appeal to the PPC it was, as expected… rejected. I have now a popla appeal code to now start a second stage appeal with popla. Couple of questions for advice please. 
    As the photos sent by the PPC show no parking restrictions signs at all as the basis of their charge  am I using this as a point to appeal? Do I need to go back to the site and find the actual parking restriction sign to show popla? In the rejection email from the PPC they state ‘As the vehicle was parked in an area where the signs clearly state "No parking or waiting at any time. No exceptions."’ However as the vehicle was parked on double yellow lines at the start of the road name in question and this ‘enforcement’ is based on a private road, there is no distinction between what is the public highway and a private road apart from a set of gates which are placed further down the alleged private road which give the impression that the private road starts from then. Can I use this to my advantage? Is there a way for me to find out the boundaries of where the private road starts? So I can clearly show a map of this to popla? What points can you recommend I use to form a draft appeal?

    Another thing to note, on the original NTK it states The terms and conditions to which the driver agrees to be contractually
    bound upon entering the site are clearly placed at the entrance to and throughout the car park, states that this is private
    land, the car park is managed by Secure Parking Solutions Ltd. So here they are claiming it is a car park but then in the rejection email it states As the vehicle was parked in an area where the signs clearly state "No parking or waiting at any time. No exceptions." the vehicle remained on private land breach of the terms and conditions. now they are claiming it’s not a car park and in instead a no parking area. Is this also something to note?
