    Very good!  IF HE DOES.

    Yes it's PLAN A for good reason.

    But actually Smart are 100% beatable on appeal as long as you don't say who was driving.

    JUST IN CASE IT COMES BACK TO BITE:

    You need to appeal the Smart one anyway, NOT TICKING 'DRIVER' and saying this (thanks to Umkomaas on another thread):

    As your Parking Charge Notice does not comply with the requirements of the Protection of Freedoms Act 2012 (Schedule 4), you are, in law, unable to hold the registered keeper of the vehicle liable for the parking charge; I suggest therefore you contact the driver. As there is no legal requirement placed on the registered keeper to identify the driver, I will not be doing so.  Finally, I have complained to the Hotel Manager who insists your fake 'PCN' is cancelled. Off you go.

    Received Notice of Allocation to the Small Claims Track (Hearing) letter.

    It will take place in Liverpool at the end of March. 

    Any advice for this stage would be most welcome.

    Look again at your Notice of Allocation. The Notice that gives the hearing date.
    Is there not a paragraph something like:
    Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].
    Might be on the back.
    Those 'documents on which you intend to rely' are your Witness Statement and evidence.

    Yes - just wondering where to start really. 

    In the defence letter it has already been stated that I was not driving my partner was.

    The claimant had until yesterday to pay £27 trial fee. Is there anyway of finding out if they have?

    By phoning the court and asking them.

    Most people here in your shoes, don't bother to check. Just assume they have and crack on with the WS bundle.
