No response to my snotogram to the MP, surprise surprise!
So the landowner and MP have clearly come up as blanks, would you bother doing anything else now or just leave it0 -
Keep at them!0

Coupon-mad said:I just re-read your OP and I'm worried you've been reading some clueless ranty rubbish by the Consumer Action Group, which is sadly as appallingly useless at tackling private PCNs as the MSE site guidance, which actually has a stupid 'mitigating circumstances' section which you also mentioned in your OP.
The facts are:
1. IGNORE UKCPS IS THE BEST ADVICE.
2. YOU DON'T HAVE TO DO ANYTHING.
3. NOTHING WILL HAPPEN.
4. THE REASON TO COMPLAIN TO THE LANDOWNER IS TO SEND A PIC OF YOUR BLUE BADGE AND TO ASK FOR A 'REASONABLE ADJUSTMENT' UNDER THE EQUALITY ACT 2010 & CANCEL THE PCN. NOT FOR THEM TO "TALK TO UKCPS BECAUSE IT WAS RAINING & YOU WERE ONLY THERE 2 MINUTES". UKCPS WILL LAUGH AT YOU.
My advice is just stop taking it seriously. Talk about the Equality Act to the landowner and remind them of the consumer duty they and UKCPS have to make 'reasonable adjustments' (USE THAT PHRASE) and not to harass a disabled person, which is illegal.Nothing has changed about my advice above.
The contact with your MP wasn't meant to be a snottogram; the point of involving your MP is to get them on your side and send a complaint and lean on the landowner and PPC on your behalf.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This was the response from the MP-totally useless
Good AfternoonThank you for your additional email.Just to clarify that Craig has no jurisdiction or powers to overturn any parking fines. There is a maximum fine for these companiesWe are not aware of any plans to change legislation. Whilst I am sorry that you received a fine, these car parks are clearly signed and these are private car parks and private land.

I thank you for your advice above, but just one question if I may.
If I did make an appeal using the official means to ukcps and disclose my information and such like, is there anything counter productive with doing this. I understand that there is 95% chance they'll refuse it but is supplying my actual details going to cause detrimental affects?0 -
Your MP needs educating. What information do you think you will disclose to the PPC that they don't know already, the VRM, the car park and the date and time of the alleged event plus the name and address of the registered keeper?2

...and this Parliamentary Briefing:

...and tell Craig to stop calling them 'fines' and stop being so utterly clueless as to say WRONGLY: "these car parks are clearly signed" when the DLUHC has categorically stated they are not, and declared just one month ago that this a 'market failure' situation addressed in the current draft Impact Assessment.
PS:
Obviously the keeper can appeal if they really want to. UKCPS already have your data.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi guys
This all went quiet and I haven't heard from them for a month then they've written to me with a 'final notice' which I presume is just their attempts to worry and demand higher payments.
I had written to them and demanded it be annulled because of disabled reasons but they seem to have ignored this.
It came to light after speaking to various people that a medical condition I have would deem that I have disabled status, therefore I gather legally I could use the disabled space on private land, (not council) without any issues.
My disability is valid just not a physical one.
I put this in the letter to them and mentioned the disabled harassment that had been stated previously.
..... To make reasonable adjustments and not to harass a disabled person, which is illegal.
I was hoping that this is enough to get them to actually cancel this but if not there's two questions....
The letter says I can complain, so I can send something signed for delivery so they can't dispute it along the lines of what I've said above
Or
Do I just ignore this letter Again and not bother with any sort of letter to them0 -
Whether you decide to send anything or not, don't send it "signed-for" as then the recipient, if they refuse to accept it, will have a record of it not being delivered - not what you want - just send from a post office with a certificate of posting; it will be deemed to have been delivered two days later.

Half way put to appeal it based on disability and I did but that didn't get too far so I plan to write back and get a cert of posting referencing the original letter and stating the disability issue again
If this doesn't get anywhere then the advice of doing nothing will be best to adhere to I'm presuming....0 -
If this doesn't get anywhere then the advice of doing nothing will be best to adhere to I'm presuming....UKCPS haven't been litigious for probably more than 3 years now. What their pattern might be in the future is anyone's guess, but the advice to you for now is to await any next move from them. Ignore any silly debt collector letters, but come back on this thread in the unlikely event of receiving a Letter Of/Before Claim, or a County Court Claim via the Northampton CNBC.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
