I've read 10-15 threads of "UKCPS do not sue/take to court etc" but is this not always the case?0 -
It is true - UKCPS don't sue.
The issue is that none of us would ever condone selfish parking in disabled bays ...so we are not posting with our usual gusto and it's hard to get on board. We don't see this one as a scam.
Indeed most of us here take the view that when the Govt regulate private parking firms in 2024, that the charge for parking in an accessible bay when not disabled, should be £100 with a discount.
No-one is going to tell you to pay.
But:
Never, ever use an accessible bay unless you have a disabled person with you.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I could get photos yeah but havent them at handLets get a few things straight , you have not been fined, but you must not ignore it - they can chase you and challenge you for it in the courts and then you will have to prove why you should not pay.No one on here will condone the deliberate abuse misuse of a disabled bay by doing so you are doing at least two things:1: depriving someone who may genuinely need to use a disabled bay2: giving oxygen to the private parking industry who will then use it as a reason as to why a PPC is needed, and then in turn will go on to persecute genuine users of the disabled provision.Some acceptable reasons for using a disabled bay/provision could be :an occupant has a long term disability but no blue badge was available or displayeda genuine mistake was maderubbish signage/markings etc ( hence the request for photos)For the reasons given in point 2, my advice would be not to pay, but to challenge this as on one side disabled bays must not be abused/used by those without a long term disability, however on the other hand putting money into the clutches of a PPC is, probably on the balance of things worse - at least with council/authority tickets the money goes into public coffersFrom the Plain Language Commission:

I think I need to address a couple of points
If truth be told I totally missed the disabled signage, its likely the first time I've parked in one as like you say above depriving someone who has the need for one is far worse than any gains I would make from using it
If I recall it was absolutely hammering it down I knew I'd be in and out quickly and I guess I just chose the closest spot. None of this is right but it happened and I accept I messed up.
Therefore, if I appeal I'd have to be honest and say this otherwise if it did get to court I'd have absolutely zero chance of representing myself in a proper light and it would be futile attempting to.
So, the process would be to appeal and sight ignorance on my part and hope they're lenient even when the chances are next to none?0 -

Do not use the template you found on the main MSE site. It is useless, out of date, and will cost you money.
If the driver genuinely didn't see the signs, then Plan A is a complaint from the registered keeper to the landowner and the keeper's MP.
If that fails, then appeal using the template in blue text from the second post of the sticky Announcement for NEWBIES.
Get photos of the site and signage.
If the driver deliberately and knowingly parked in an accessible bay when an occupant of the vehicle did not need the reasonable adjustments offered by the use of said bay, then the driver is one of the reasons why unregulated private parking companies exist.I married my cousin. I am happy to write to the registered keeper MP- I have found this and sent an email on the grounds of not having seen the signage clearly due to the inclement weather when I visited the car park
How do I find out the landowner?
If I dont get a response within a set amount of days will this impact upon the supposed 14days rule and add supposed cost to what they believe I owe?
