I’ve read it but I’m not sure I understood it.
Please tell us what is hard to understand as I've tried in the NEWBIES thread to make this stage very easy.
All the stuff about signs. I don’t understand why it’s relevant. Also where it says most magistrates are aware of the scam, I was told informally by one that the tickets are valid and the best possible outcome in court is to pay £1 a month and I should try mediation.

Also, how do I know which the trade body is?

it probably is all explained properly but my stress levels are high because of lots of things right now and I’m struggling with keeping on top of paperwork and I don’t know where to find things.
The signs are crucial. They are the means by which the contract is set out. If they are not present on the day, unreadable or unclear in terminology then there is no contract to be breached.

The trade body should be shown on the signs and the NTK
The pen is mightier than the sword ..... and I have many pens.

Magistrates? They aren't involved. Who told you informally to pay a scam PCN?

    Citizens advice bureau.
    Ah yes.  Hopeless.  Ignore that.

Not a magistrate or Judge then, just an advisor reading some spiel off the CAB website, which was influenced by the BPA (parking firms) years ago.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

No, the advisor reading the spiel made an appointment with a suitable specialist, who was a magistrate.

I think I’m getting my head around it.

  • I've done my witness statement (I know I'm cutting it fine as I only have a couple more days to get it in). I basically copy and pasted one of the exemplars then chopped it about a bit to fit my case. To make it easier I've bolded the bits I changed. I'm still tracking down and adding in the exhibits but I think everything else is ok. It would be good if someone could check it out for me. Hopefully this works, I'm not good with technology.

  • Hopefully final version with evidence attached. I tried to tidy up the gaps between pictures in the evidence but couldn't.

Change 'the Defendant' to 'I' because this is your own story.

    e.g.
    the Defendant parked their vehicle

    should be

    I parked my vehicle

Also, the CEL v Chan case must be an image of the actual transcript not copy & paste.

You can save three or four paragraphs simply by using the judgments link that's given in the NEWBIES thread exhibits list (in the bit about WS stage). The judgments link by @Le_Kirk has all the recent judgments in it, starting with Chan.  ONE exhibit not several.

  • Thank you. I thought I'd read somewhere that it should be the Defendant, not I, so I'll change that.

I somehow missed the link to judgements, I was googling each one to find them. At least I can cancel my Scribd subscription now.

'Defendant' (third person) in the Defence, 'Me', 'Myself', 'I' (first person) in the Witness Statement.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
