Are you absolutely sure that the order says "serve opponent"? You must be very accurate when you tell us something. If in your mind it means "opponent" but actually says "defendant" or "claimant", then please state precisely that.

As the above letter is a "threat" rather than an "offer", you may want to reply to them (include a copy of the photo of the letter) and say that you will be producing that letter in court to show how their letter is an abuse of process. They will not be able to rely on their "without prejudice" bit and the whole of their letter will be revealed for what it is. Tell them that you will be asking the judge to rule this as unreasonable behaviour and to award you cost on that basis.

Just a thought.

Why do you have to file an application and pay another fee? Are you sure?  Maybe it just says that IF YOU WISH TO AMEND YOUR DEFENCE?

Please show us the Order (minus your data).

I am able to get help with the fees I think. I can apply for that today if needed or am I reading this completely wrong. To be honest I have no idea what any of this means hence why I was starting to think to just try and and see if I could go into a payment plan with them.

But that document says that the "claimant" must pay the £27 fee. You are the "defendant".

You don't have to file an application!  That bit is talking about the CLAIMANT.

You are the Defendant. You don't pay a fee.

All you have to do is do a signed WS and evidence bundle, easy peasy!  Point 3 tells you that, and your deadline.

You no longer have a CCJ. The original CCJ was set aside successfully. Those orders are for the claimant to submit their trial bundle no less than 7 days before the hearing date.

You job is to now defend the original PCN by submitting your WS.
