You can c&p; no need to type.  But why sit on that one - it's just one example of lots like it.

There are dozens of threads from September about the HHJ Murch case that you could choose.  It always worries me when a poster hasn't read other recent threads and when given a link to one case and provided with knowledge of exactly what they are looking for, doesn't just run with that new knowledge and find other alternative recent WS threads to read.

Hi there,

I have read through and researched a number of threads and wtness statements over the past few days @Coupon-mad when you get a free minute would it be possible to have a read. I have taken out my tenancy agreements.

Should I also include my recent letter from VCS asking me to pay a reduced settement of £145 x2 and if i dont settle they will seek a further £220 x 2 from me for solicitor costs.

They said they would be showing the offer letter to the courts however its not in the bundle they I recieved this morning.

Also all photos they have sent me of signs are dated 2019 I moved out in 2018 not sure if that means anything.

You can't.  And that's why they haven't.  Offers made on a WP basis cannot be disclosed to the court at this stage.

Remove this line:

"The Defendant asserts that this Claim is based upon an agreement by conduct."

And remove ALL the stuff about Fairlie v Fenton.  It's completely irrelevant to your case and I'm surprised you copied that because VCS signs don't have 'ABC Parking Ltd' on them.

Why did you remove your tenancy agreement? Surely the usual stuff about primacy of contract is a big point?

Plus you should be adding that by withholding permits from some residents, VCS made their own alleged contract void for impossibility.

And you should be pointing out that their photos are from 2019 which is a year after you moved out so completely irrelevant, especially given the fact that VCS were dropped then reinstated at least once around these years (and private parking signs across the UK all changed with the advent of the GDPR in 2018). Therefore, it cannot be assumed these were the signs in 2017.

I read through Exhibit 08 and then copied without checking that part.

 I took out the tenancy just for privacy purposes I will send this through to court. I will add the above.

Good morning,

I am going to send over my witness statements today as it needs to be in by Monday latest.

It says to file at court and serve on you opponent....Do i need to email a copy to VCS or just the court?

I have signed and triple checked everything , should I convert to pdf?

I have copied each statement as the court have left this as 2 x hearing for each claim.

The 12-point checklist you are supposed to be following from the first post in the template defence thread explains.

It must be converted to a PDF and sent to both the court and the claimant or their solicitor, if they're using one. You send the attachment in one email addressed to both the court and the claimant and you CC in yourself. That way, if you receive the email, you can evidence that it was sent.

VCS have sent me everything through their own litigation department so will include them in the email.
