I had a snoop around and seems no news still. Shall I cut my losses and submit? I'm going to be flat out at work tomorrow and the last thing I want to do is forget to submit it (this time of year I'm doing quite long hours). In due course, your Witness Statement can be used to reflect the musings of the DLUHC's Impact Assessment. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Okay so can confirm, 2 separate email defences sent to CCBCAQ@Justice.gov.uk and got 2 auto replies from them confirming receipt. Hopefully this means I'm in the clear?1

2 weeks after submitting defence and radio silence. MCOL showing that the last event on both claims is “Defence Received” on 24th July.No DQ received nor a statement of intention to proceed. Is this normal after this time?0

I received a letter, dated for the 14th August with intention to proceed and offer to settle. However this is just for 1 of the 2 DCB claims.
I checked MCOL but this hasn’t updated. Should I proceed to fill out the questionnaires for both in anticipation anyway?0 -

Item 7 on that checklist you were following when you filed a Defence says...Items 8, 9 and 10 on that list might be worth another read too.cheme7676 said:I checked MCOL but this hasn’t updated. Should I proceed to fill out the questionnaires for both in anticipation anyway?
The CCBC sent you a letter, or will send you a letter, saying the Claimant has twenty eight days to consider your Defence.
What you don't know is when the CCBC sent a copy of your Defence to the Claimant. It follows from that that it is not known when the Claimant has to respond to the CCBC.
Further, we don't know what delays there are in the CCBC that means they don't send you a Directions Questionnaire as promptly as you might like.
And as @Coupon-mad says above, longer delays are likely.
Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back at the CCBC, remembering to send a copy to the Claimant of course?1 -
Thanks for the response @KeithP
I was expecting this yes, I was just surprised to see that they only responded to one of the two cases - despite a week passing by. Not that it changes anything - as you mentioned delays are possible.
Good suggestion, I will check MCOL daily. I will also download the DQ and fill it out in anticipation and send it back once MCOL is updated respectively.
Just to confirm, I send the DQ to the CCBC and DCB Legal in individual emails right? i.e. I'm not cc'ing DCB Legal in the same email to the CCBC? Not sure if it makes a difference but wanted to clarify that point.0 -
