Letter of Claim from DCB Legal

Hi Guys, I got this letter from DCB letter, please help.

  • This is my first letter since I moved address recently but seems to be the 2nd letter they usually send. I only have a week to get back to them. Please advise.

    Dear Sir,

    I am writing in response to your Letter of Claim dated 15/05/2023, requesting 30 days to seek debt advice in accordance with the Pre-Action Protocols, specifically section 4.2, which states that the Creditor must not start court proceedings less than 30 days after receiving the request.

    I acknowledge the receipt of your letter. However, I must firmly state that any debt claimed against me is denied. Please provide me with all relevant documentation and evidence to support your client's alleged claim, including any agreements, contracts, or invoices pertaining to the alleged debt. This will allow me to assess the validity of the claim and respond accordingly.

    In the event that you are unable to provide the requested documentation or evidence within 14 days, or if it becomes apparent that the claim lacks substantial merit, I will fully and robustly defend the claim.

    Please acknowledge this request as it will be deemed to have been received by you on the same date as it is sent by email.

    And in addition, send UKPC and DCBLegal's DPO a data rectification to ERASE YOUR OLD ADDRESS to stop the possibility of the inevitable court claim going to the old address.  

    You can't leave them holding a choice of two.

    As this is a UKPC/DCB Legal combo, have a read of the following thread. It's not a reason to be complacent, you must go through each phase and on time, but there is definitely light at the end of this tunnel for you.

    Not in UKPC/DCB Legal cases. As the DCB Legal Particulars of Claim (POC) will be shoddy template generalisations with no indication of the specifics of the defendant's 'crime', advice is not to seek clarification via a SAR, so, in knowing no detail, the defendant is much freer to defend purely against the POC given on the court claim form.

    Agreed. That's why I didn't say to send a SAR.

    You must do what I advised though. It's vital.

    Perfect, if that email is dated July because the 30 days will take you into August.  Past the date when the DLUHC publish their detailed draft Impact Assessment and Consultation .

    Great timing! 

    You need to know that July is an important time for a private parking announcement from the DLUHC that you can use in your court defence.

    We hope we can count on you to come back here in August to join us to get the new Code & law over the line and past the rogue PPC industry at last?

    Read my posts about the Judicial Reviews and the upcoming PUBLIC CONSULTATION.

    See you in August...we will be discussing it and we very much hope the added £70 will be banned (again) as the DLUHC first did in Feb 2022 before the parking industry money-grabbers temporarily blocked it.
