Received a DCL for a Parking Ticket I know nothing about. Lost the letter.

    ...you have until 4pm on Monday 4th December 2023 to file your Defence.
    When I wrote that you had four weeks to file a Defence.

    I'm so sorry for taking up your time and reaching out. I have ADHD, and as such really struggle with information overload, instructions and comprehension. Reading through all the posts, I feel a complete failure that I just can't make sense of it, I just feel totally overwhelmed. I'm reaching out in private, to stop me feeling like a total fool, keep asking the same questions, and I keep getting signposted to the same in depth information. I simply can't understand it.     I was going to give up,but I have until tomorrow as I don't have a car at the moment. I actually thought I could just send an email defence, I didn't realise it had to be a PDF.

    I finally found the defence template. I understand I just have to adapt points 2 & 3? Although the allegation is overstaying. I am an avid clock-watcher, so I struggle to see how this is possible, unless there was a queue to get out. I feel I may have gone to Halfords on the same day, but I am a cash payer, which has backfired enormously here. Going into Halfords I don't turn left or right into the main carparks, and there are no signs up to where I parked. I didn't think it was part of the main parking. there was a sign far to the left, but that seemed for a different part of the car park.There is a small sign on entry which you would never be able to read in a car at that angle. No signs on the way out. I met friends for coffee in the main par park. I have dropbox pictures of the signs, but I wouldn't have overstayed. If there is a chance I had, it would have been less than 10 minutes.  

    I have only made these changes to the template. The Claim Form is signed Yasmin Mia. The original fine £90 looking at the signs. It was £170 when the first letter got to me, so I have no details of the times in and out alleged. 

    I changed (5). also, as it is an alleged overstay. But I didn't mention the possible returning within 2 hours, which is possible. I simply didn't realise this at the time. Part of ADHD is a very poor working memory in my case. 

    2. It is admitted that the Defendant was the registered keeper of the vehicle in question.

    3. The Defendant is unaware of any overstay on the day in question if that is the allegation (it being completely unclear from the pleaded Particulars what overstay is alleged).  Even if the court is satisfied that there was a minimal overstay of minutes in order to exit - which is neither admitted nor denied -  any attempt at punishment under contract is meritless and overridden by the XXXXXXX?  with no grace period allowed for the Defendant to exit the area in busy times.

    4. The Particulars of Claim ('POC') appear to be in breach of CPR 16.4, 16PD3 and 16PD7, and fail to "state all facts necessary for the purpose of formulating a complete cause of action”.

    5. The Defendant is unable, on the basis of the POC, to understand with certainty what case is being pursued. The Defendant has had to guess the PARTICULARS the Claimant alleges was breached; in a free retail car park. Other terms on the sign are DIFFICULT to read and do not assist in shedding light on the incoherent POC.

    I really don't expect you to be able to help me. I thought it was worth a try before I give in to the inevitable. The fact is, I couldn't pay if I wanted to.

    What?  You aren't filling out forms.  You can't put the defence into the body of an email.
