Received a DCL for a Parking Ticket I know nothing about. Lost the letter.

    I received a letter on Saturday 4th dated October 30th which said I have 14 days to reply. 14 days from the date on the letter?

    CLAIM FORM: CP PLUS LTD T/A PROUPNEXUS
    The fee has gone from £178.24 +£35 Court Fee + £50 Legal Representative's Court Fee = £263.24

    The letter states I must return the letter back to the Court. This includes a Response pack, an Admission Form/Financial Statement of income, and expenses and a Defence and Counter Claim Form.

    Do I still do nothing?

    If needed:

    Particulars of the claim
    1. The defendant (D) is indebted to the claimant (C) for a Parking Charge(s) issued to vehicle xxxxxxxx at Cannon Lane Retail Park, TN9 1PN. The PCN details are 07/03/2023 xxxxxxxxxx 3. The PCN was issued on private land, owned or managed by C. The vehicle was parked in breach of the Terms and Cs sign (the contract), thus incurring the PCN (s) 4. The driver agreed to pay within 28 days but did not. D is liable as the Driver or Keeper. Despite requests, the PCN (s) is outstanding. The contract entitles C to damages.
    AND THE CLAIMANT CLAIMS
    1. £170 being the total of the PCN (s) and damages. 2. The interest at a rate of 8% per annum pursuant to s.69 of the County Courts Act 1984 from the date hereof at a daily rate of £0.02 until the judgement or sooner payment. 3. Costs and court fees.

    That looks like a N1 claim form, would that be right? Did it come from CNBC (used to be CCBC) in Northampton?  If so, you need to read again the NEWBIE sticky to find out how to complete the AoS.  What was the date of issue of the claim form?

    You don't ignore a Claim Form. It's not just a 'letter' and you don't fill in any forms, which you'll already know from your reading of the second post of the NEWBIES thread.

    Do the AOS first (online) then defence by email just as the advice thread says.

    With a Claim Issue Date of 30th October, you have until Monday 20th November to file an Acknowledgment of Service but there is nothing to be gained by delaying it.. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 4th December 2023 to file your Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. 
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Thank you for the reminder.  

    My visit was for coffee with friends at Costa. I tried to find the email address of the retail parks management, and couldn't find one so I didn't complain. I now wonder if I should have complained to Costa and not the retail park management. Is it too late to do this now? 

    I completed the AOS the day after my post.  Was the 'LETTER OF CLAIM' the letter before the claim, or would it be titled 'LETTER BEFORE THE CLAIM'? Sorry if this is a silly question. This was the letter I received before I received the Claim form pack, from which I completed the AOS.

    I understand that I now have to prepare my defence email, but I don't know how this is possible if I don't know what I did wrong.  It states the "Vehicle remained on private property, in breach of the Prominently displayed Terms."
     When we have coffee we always put alarms on our phones, so we do not overstay. There is a chance we went over by a few minutes, but it really would have been a few minutes, not more. The second scenario is that I accidentally revisited within the no return within 2 hours. Which to be honest, as my local shops, I didn't even think about. ADHD impacts my time awareness and my attention. But this visit would have been in and out, not to browse and shop. 
    I have heard from others, when you revisit this car park, they sometimes do not take it as two visits, but the entry time of the first visit, and the exit time of the second visit. 

    I am neurodivergent, so really struggling with so much complicated text and instructions. I feel I'm totally at a loss here, and a bit embarrassed. .

    I quite often post the following advice.  It might help, but it's not a guarantee of success. But unless it's tried, you'll never know:

    SOME IDEAS FOR DETERMINING WHO OWNS THE LAND 

    1. Google searches
    2. If a retail park, check on any signage which lists the on-site outlets
    3. Ask retailers on the site if there is a managing agent
    4. Ask retailers on the site to whom do they pay rent
    5. Contact the local authority and ask who pays the non-domestic/business rate for the car park (some councils have a spreadsheet on their website)
    6. Contact the local Valuation Office and ask if they know. They often have a website which might provide the information 
    7. Contact The Land Registry and for around £3 they should be able to provide definitive detail
    8. If you haven't already done so, give us the name of the car park/site/location, we may have seen other cases there. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    It is a myth that the most important person in a group is set at the top of a Totem Pole. They are in fact depicted at the bottom, because it's the first thing a visitor sees when they approach.


    I would start with the managing agent for the site, details of which are depicted at the bottom of the totem sign on the left of the entrance.
