    If they are going to discontinue the case then that usually happens later - a couple of weeks before any hearing.

    I have a date! The letter says something about if the claimant doesn’t pay £59 and fill out the paperwork correctly it’ll be struck out! 

    Do I start my defence now!?

    No, don't bother with that. You filed your Defence last year.

    Look again at your Notice of Allocation. The Notice that gives the hearing date.
    Is there not a paragraph something like:
    Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].
    Might be on the back.
    Those 'documents on which you intend to rely' are your Witness Statement and evidence.

    Hi guys! My court date is 17th June and DCB have until the 20th of May to pay the £59 court fee and “file a properly completed application for help with fees” … I am hoping to receive the much awaited discontinuation letter before then, however, in case it does go ahead can you recommend any guidance/forums to read on writing a witness statement?

    The NEWBIES FAQ Announcement, second post, has it all there, along with links to exemplar Witness Statements. You need to be cracking on with yours as the deadline for submission will be racing up on you. Read your Notice of Allocation letter to check your deadline. Often an actual date is not given, rather a sentence on the reverse side which says (to the effect) 'fourteen days before the date of the hearing'. Check it out as it can differ from time to time. A number of people have missed this in the past; the consequences were expensive!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Yes for sure! Dates all in my diary… they pay by 20th, “each party shall deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than 14 days before the hearing” which would be 3rd of June, however like a fellow person I don’t know how to submit the WS.

    It's in the Announcement, but in short .... as an attachment to an email.  If it's going to be 'weighty' you might need to bear in mind that some courts limit it to 50 pages/10mb. If you're nearing either limit, check with the hearing court. You may have to print if for the court, but you can still send by email to the solicitors.
