    It's a good point.  Why aren't they able to filled in with a few boxes on MCOL?

    Hi, can anyone advice me on this i have a court date for September 10th and still not sure how to write the witness statement they have sent me a copy of theirs.. is it a case of copy and edit from this group or do i just write what happened on the day and read it to the judge on the court day?

    ***We act for the Claimant in the above matter.  

     Please find attached, by way of service, the Claimant's Witness Statement.     

     In accordance with CPR 27.9 our Client hereby gives notice that it will not be attending the hearing. 

      We confirm the court has been informed and that we have asked the Court to decide the claim in our Client's absence based on the evidence submitted.   WHAT DOES THIS PART MEAN JUST THEIR LAWERS WILL BE THERE OR THEY ARE NOT SHOWING UP??

    We confirm the statement has been filed at the Court****

    You've been very quiet for almost a year.

    Some time ago your case will have been transferred to your local court and you will have been sent a Notice of Allocation.

    The fact that you have now received the Claimant's Witness Statement and evidence suggests that your Witness Statement and evidence are now due.

    Look again at your Notice of Allocation. The Notice that gives the hearing date.
    Is there not a paragraph something like:
    Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].
    Might be on the back.
    Those 'documents on which you intend to rely' are your Witness Statement and evidence.

     yes i have enough days to submit but i just need help writing this the defense and feel nervous after reading the judges rule on how to write it and say at the court.

    You have already submitted your defence surely and are about to write a witness statement; use one of the exemplars in the NEWBIE sticky second post.  Pick the one that most nearly fits your circumstances but CHECK for differences such as the PPC, location and the BPA/IPC.

    This is just a small part of the Claimant's witness statement, I don't understand why they're mentioning that i'm using online help and does it matter that they deny my defence?

    "The Claimant would like the Court to note that the Defendant is using, for the most part, a generic
    defence which can be found on the internet. It is highly doubtful that the Defendant would
    understand the complexities of all the references to the Civil Procedure Rules, the requirements in
    the Act and in established case law, which is often the case when a Defendant is questioned about
    such references at Court. Therefore, everything that the Defendant has outlined is not accepted
    and denied by the Claimant."
