The alleged contract with FlashPark would be a secondary contract (if a contract existed).
This is covered by Section 72 of the Consumer Rights Act 2015 which applies Part 2 of the Act to secondary contracts i.e. they must be fair (see section 62 - if terms are not fair, you don't have to comply with them - charging you for a right you already have would not be fair).
