I very much doubt that OH said they were pointless and stupid questions and the employer does have a choice, without reasonable answers to those questions the employer has every right to terminate your employment.

I mean... they are the questions to ask OH when you am trying to work out if you should let someone go... no date = endless situation = start the parting of the ways.
They may be useless to OH, but they are not useless to an employment law specialist.2021 GC £1365.71/ £24003 -

I cannot comment on who said what as I wasn't there.pope said:Just to give a update I had my Occupational health refferal assessment today over the phone it was 30 minutes long the person was really nice and asked about my health and how I am. Employer has asked 4 questions
When will I return to work
When will surgery be
Will I return to work after surgery
Can we do anything to help back in to work
All of these questions the OH said are pointless and stupid questions. OH actually said that Employer has no choice but to wait untill I have had my surgery as there is nothing else that can be done.
No mention of medical record request.
What I can tell you is that if you are interpreting that to mean that your employment cannot be lawfully terminated in the meantime you are sadly mistaken.5 -
I need to do all I can to keep my job. If employer does decide to dismiss me on medical grounds then it will have to be that. At the end of the day health comes first. If this job goes I guess I will have to find another When I get better.Undervalued said:

Have received my Occupational Health report today as I asked to see it first and then my employer gets a copy.
Does any body have any experience on what will happen now? Will employer call me in for a meeting

OH are used by employers for 2 reasons only- 1) to force the employee back to work or 2) to sack the employee. The outcome will be one of these. After my experiences with OH in the past 10-15 years ago, I wouldn't trust them, they are employed and paid for by the employer with the sole purpose to please the employer who is paying their invoice. Do not trust OH.
