Two NPM/Gladstones Cases - WON AT COURT
Comments
-
Got an email from CCBC as well. Both my defence have been filed.1
-
Today I got 3 letters in the post and 2 emails:
1 letter from Gladstones confirming they have updated address.
2 letters from HM Courts & Tribunals Serice, confirming they have my defence for both claims, they sent copies to the claimant/claimants solicitors.
The emails are from Gladstones, they sent a copy of their N180 directions questionnaire for both claims.
They ticked Yes for 'Do you consider that this claim is suitable for determination without a hearing?' on both directions questionnaires.
I'm currently waiting for my own Directions Questionnaires.0 -

The recommended answers to fill in by bargepole goes up to D4 but no E it needs updating https://forums.moneysavingexpert.com/discussion/5546325/court-claim-procedure-updated-october-2016/p1

Got 2 replies via email from Gladstones
First:
We act for the Claimant.
Thank you for your email and apologies for the delay in returning to you.We note your concerns regarding the separate claims filed against you. Please note that the two referenced claims that have been issued on have continued separately due to differences contained therein such as the location that the contraventions occurred.
The Claimant's position is that the charges were issued correctly and they have a real chance of success on the facts.
This one is funny because there was a Letter Before Court last month relating to the same location as the first CCBC claim I recieved... so if they send another CCBC claim it would then be 2 claims from the same location...
Second:
Thank you for your email and for the attached in respect of the above matter.
The site where your vehicle has parked is a private land where permit must be displayed at all times and so no grace period apply.
Pursuant to the photographic evidence (attached for ease of reference) your vehicle parked in front of the signage informing drivers that restrictions apply. Your vehicle parked without permit, thus you were in breach of the terms and conditions laid down for parking. Notwithstanding this, you were still parked in a manner that incurred a charge.
It is our Client's position that the charge was issued correctly and remains outstanding in the sum of £170.00.
Payment can be made via bank transfer to the account detailed as follows...

Dear Sirs,
I've read your email.
A different location is wholly irrelevant to the doctrine of cause of action estoppel. Have you got a law degree or are you a roboclaim hotdesk minion?
Ever heard of the Overriding Objective?
Get a grip on rules of law and stop harassing and exposing victims with 'drip, drip' series of separate claims that involve the same parties, with your clients rehearsing the same tired arguments and expecting the courts to allow multiple hearings and duplicated fees.
I'll show this email exchange with my Witness Statement bundle for each and every near-duplicated claim your clients pursue against me.
Yours faithfully
