I received 2 letters from CCBC through the post.

Both of them are regarding the 2 claims I am currently defending.

I am not sure why they are asking me to complete a Small Claims Directions Questionnaire (N180) again...
I already completed this for both claims weeks ago and emailed it to them.

Not sure If I should complete the forms again and this time post it to them?...

No just re-send the email with attachments and make sure you get the auto-reply.

Just resent both Directions Questionnaires to CCBCAQ and got an automated response back.

I also sent a SAR again to NPM regarding the recent LBC which included PCNs dated back to 2020.

When I initially sent a SAR to NPM a couple of months ago they said this is all the data they have on their system in my name and it did not show any PCNs from 2020...

So I am not sure how they can send a LBC threatening to take me to court when their own system does not have the PCN/NTK data to back it up...

You keep the evidence for when you make your complaint to the ICO. If they produce information from the time they said they had no further information, you have them bang to rights for an ICO intervention.

Yes, I'm keeping all the evidence saved. They still haven't replied yet.

Got 2 letters through the post.

It is about the 2 ongoing claims, just stating that The claim has been transferred to the county court hearing centre for allocation...
And that it is referred to a procedural judge who will allocate the claim to track and give case management directions.

Got an email back from NPM regarding the SAR.

They sent me data from 2019-20 regarding 4 PCNs. This is for sure all the data they have, I never had any issues with NPM before 2019.

I am not sure why they didn't release this data when I initially sent them a SAR few months ago.
Back then they only provided the data from 2021-22...

Got an email back from NPM after I told them about how they concealed my data when I initially sent a SAR back in May:

    ''Good morning,

Thank you for your email below regarding your previous request for a subject access request.

I can confirm that NPM currently have two systems which hold parking charge notice data, our old system iView and our new system ZatPark. The old system (iView) which we no longer use and is only kept for reference is not as useful and as easy to find data as the new system (ZatPark). iView is very limited on the search facility and the data which is on there is not easily transferable, but the new system ZatPark is. This is one of the many reasons we no longer use iView although we do still have access to obtain data which we hold.

We have provided you data from both systems from the iView system your parking charge notices which being with 912 and from NPM your data which beings with NPM.

Due to the nature of the facilities on iView we were originally unable to find any additional information but after a further investigation this was obtained and sent to you. The search on both systems has been exhausted and there is no other information we can send you relating to registration...''

Sounds like such a ridiculous excuse. ''Oh we didn't reveal all your data because we have 2 systems and in the old system it's hard to find the data''

    Absolute joke.

  • I received a reply today after raising a complaint to the ICO regarding NPM withholding my data:

    Our view of your complaint

We have considered the issues you have raised with us. Based on this information, it is our view that National Parking Management Limited has infringed their data protection obligations. This is because you did not receive an appropriate response to your subject access request. What we expect the organisation to do We have written to National Parking Management Limited about their information rights practices. We have told them they should now ensure that:

    · All relevant staff attend mandatory training which is routinely tested and refreshed;

    · All policies and procedures are updated and revised to reflect the new obligations placed on controllers and processors under the GDPR; and

    · All data processed by National Parking Management Limited is subject to appropriate technical and organisational security measures.

NPM definitely infringed their data protection obligations.

I wonder how many other peoples data they infringed too. I am just happy the complaint succeeded.

More people need to send complaints especially regarding organisations like NPM.
