LBC - Gladstones - Parking Control Management - Kindly requesting advice and review

    Make sure you attach letters to provide evidence of the bullying demands.

    Obviously state at the start of your email response to the DLUHC that you are a consumer and are answering Question 4 and that threatogeams with increasing extortionate charges bear all the hallmarks of a scam and did not cause you to pay up.

    The added £60 or £70 on top of an already very high penalty (for parking at your own home) makes people less likely to settle the matter and of course, more likely Gladstones will litigate.

    It is not something you wanted to happen but you did not pay the unfair PCNs which have now become extortionate - £850 - and you will now have to defend these in court, because the way the PCNs are ever-increasing looks like 'extortion' or a scam.  This is not something anyone would just pay.  It is clearly unfair.

    Add that you want your evidence to help inform the DLUHC to ban the added £60 or £70 per PCN 'fee' that adds hundreds of pounds and is nothing to do with debt resolution but all about funding and driving cases on a conveyor belt to court.

    Change the law... we already are...

    So new updates from Gladstone this morning,

    A letter dated for the 14th came in today (25th) essentially 11 days later. Im starting to think they are sending letters of late on purpose, 

    So this new update from Gladstones has added a new extra charge from 2019 at £160. This now makes my total £1010.00.  No new court dates however. They have stated however if no payment is actioned by the 14th of next month they will "commence legal proceedings without further notice."

    Going to awaite further for the court dates when it comes

    Coupon-mad - Probably a stupid  question but, am I ok to upload the whole of the documents from Gladstones to the DLUHC via their email or would you advise to black out my personal information ?

    I'd leave your name & all details showing so it's clearly your case.  Make sure you are answering the question and the evidence supports your answer.

    Hi,

    I hope you are all keeping well, 

    So further developments with this on going case of mine with Gladstones. I recieved a email yesterday at 4pm saturday. 

    I wasnt sure what it was in regards to so I open it and see the following, Supposedly there was a court hearing at Swindon Court yesterday which I was not aware of. 

    I was completely shocked as I was awaiting a court hearing date. I was essentially updating yourselves with any further corresspondence from Gladstones so this was strange to say the least. 

    I alsw checked the PCN reference number and can confirm it was not of any of the 5 PCN numbers submitted from Gladstoned in their SAR mentioned in this post. 

    Please review the screenshots for more information. 






    They didnt send me a court date for this nor was I aware of the existance of this PCN. As you can understand it has caught me by suprise and added quite a bit of stress. 

    Any advice here would be greatly appreciated

    You may want to buy a Calendar as it refers to 2021!!
  • It looks to me that Gladstones have already had a separate undefended claim for perhaps 4 PCNs awarded in their favour. You need to investigate and unpick this as to exactly why you could not or did not defend fully and why you were not made aware of the judgment. Is it for the same PCM car park where you / your father live? If so it might help you as Gladstones should have advanced their whole case against you in their original claim

    Completely different 4 PCN case with a CCJ from 2021.

    It will presumably be that you were never told about that hearing and that it went to an old address? 

    Unless you DID know about the hearing and ducked it (no excuse if so...) you need to apply to set the writ aside and for the claim to be dismissed and CCJ set aside and all your costs refunded by the Claimant.

    Setting a writ aside costs £14.  But there has to be a writ in existence first.

    Ring Swindon court and ask them to dig out the papers from 2021 and tell you what address they used to inform you of that 2021 hearing (if you knew nowt about it).

    Completely different case with a CCJ from 2021.  It will be a claim that went to an old address which is fairly easy to unpick.

    You need to apply to set the CCJ and writ aside and fir the claim to be dismissed and all your costs refunded by the Claimant.
    That was my first thought; but, the Judgment refers to a "standard form internet defence" being put forward.
