  • I’ve actually just looked at the NEWBIES thread and found exactly what to do….I don’t mean to sound soft but the idea of having to go to court and speak to the judge fills me with gut wrenching anxiety. I don’t know how successful me saying, I wasn’t aware there were parking restrictions and I didn’t know you could leave the site once parked, will sit well with the judge? I don’t mean to be negative but I see myself loosing and having to pay quite a lot of money for nothing, it’s awful and frustrating and hate having to rely on the judge taking pity on me. I’m more tempted to go down the mitigation route as I don’t feel my case is strong enough. I think I need a pep talk!?
  • There is also an add on the questionnaire asking ‘suitability for determination without a hearing’ shall I say yes or no? Again the idea of being face to face with a judge makes me want to say yes but then not being able to get my point across verbally makes me feel I’d be more likely to lose so maybe say no?

    Judges in general are nice people, and most are sick to death with these timewasting claims like "leaving site". One judge recently blasted UKPC SAYING they are ridiculous and with the legal involved it was extortion

    So, you left the site but UKPC have to prove they had signs warning you at the border of their site.  ..... never seen UKPC signs warning people. It may be in the small unreadable signs you need binoculars to read

    It is these important parts that judges will rule upon

    You already know that DCBL are famous for discontinuing these very dodgy claims, normally at the last minute because they are hoping you are a mug and will pay up

    DCBL will be complete fools to go to court, that's why they discontinue, it's nearly become a daily joke

    Suppose you did lose if it ended up in court, the majority of judges will not allow the fake add-ons that DCBL apply and indeed the interest as well.
    You will pay less if you lost than DCBL ARE CLAIMING

    And if you lost, doubtful, as long as you pay within the time period set by the judge THERE IS NO CCJ

    When you win, you can claim your costs

    Will DCBL want a court spanking ? NO ... because UKPC claims are rubbish.   IT'S ALL A BIG TRY-ON

    Play their silly game and be patient, you could be the next in the DCBL discontinuation thread

    I did some work a few years ago in a judges house, yes it was big, in the country, they had  a nanny and an annex, there were photos of him in full regalia walking in some procession.
    He was also a nice, friendly chatty bloke, with five children that made us a coffee, not intimidating at all, just be yourself.

    Search the forum for "new questions on the DQ- N180" without the quote marks and all will be revealed.  Basically - NO

    Just keep following the steps as advised. If I were a betting man, I'd put money on that this will never get to a hearing. 100:1 that DCB Legal send you a discontinuation notice before any hearing date.

    You do not need to write another Defence.
    The Defence you have already filed will be used.

    However, as your Notice of Allocation says, you do need to file with the court and serve on the Claimant 'those documents upon which you intend to rely'. Those documents are your Witness Statement and evidence.
