  • I think the title register is fine.

You could host the whole lease in Dropbox and provide a shared URL link to it (to prevent them saying the excerpts are not proof that they even come from your lease as opposed to 'any lease').

Ah yes that sounds like a good idea, guessing could also attach it as a PDF with the WS when it is sent to court etc
  • Just another thing to point out is that the claiment did offer a reduced fee after i submitted evidence in the early days of the pcn which I refused to pay out of principle. Needless to say they did not comment on the evidence I supplied or admit that the pcn was not valid. They called it a "good will guesture"

could this go against me in court potentially?

No.  Too many pages - they won't accept that, which is why I suggested a URL as a footnote.

    No.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • That is a draft copy please let me know your thoughts. I still need to find a few of the case studies. The Jopson v Homeguard case study is a copy and paste of editable text, assume thats ok?

All personal information should be blanked out or removed.
As far as I am aware no one can edit/ download/ change/ remove the blanks this without my permission. Please let me know asap if i am mistaken. Thanks

  • Also in the newbie thread it says: When you get a hearing date, THAT SAME LETTER gives you on page two, the deadline by which YOU MUST file the evidence ('exhibits') and any Witness Statement (i.e. yours - YOU are the witness).

I can not see anything on the letter pertaining to this. It seems to be more guided towards the claiment. There is just a date of when the hearing will take place. When the claiment must pay trial fee and the date when letter was sent.

Look again at the Notice of Allocation. The Notice that gives the hearing date.
Is there not a paragraph something like:
Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].
    Might be on the back.
Those 'documents on which you intend to rely' are your Witness Statement and evidence.

This is on the back. It does say I will need to send an electronic bundle 3 days before the hearing?
Can not see the paragraph you refer to on front or back. Its titled 'Allocation to small claims track (hearing)'

Then it was in your previous court letter.

The Jopson v Homeguard case study is a copy and paste of editable text, assume thats ok?
No.  It's an approved transcript PDF.

Looks like you have just copied and paste without due regard to your specific case  -  i.e. paras under 24 talk about faulty keyboard and wrong VRM.
The exhibit numbers in main WS, list and exhibits do not match.
Chan case has a different claimant to yours  -  there may be more but just skim read.

No.  It's an approved transcript PDF.

Previous letters were a notice of transfer of proceedings (to local court) and Notice of proposed allocation to small claims track (which contains N180 form which I did and sent electronically) Can not see it in either.. Could be me missing something or misunderstanding but can't see that information at the moment
