I was just thinking aloud.eskbanker said:
Seemingly it does, but that won't be any consolation to OP, who didn't book with Tui....NoodleDoodleMan said:Just a thought - does TUI's Flex booking deal permit customers to change their minds ?

Just done a dummy run and when you choose the payment options there is a link on that page that takes you through to this. You don’t need to read all the booking terms and conditions to find it and it’s there before you choose to proceed.
Cancellation charges
If you cancel your booking or if we cancel it because of non-payment, you shall still be required to pay (to the extent not already paid):Any non-refundable supplier charges in connection with accommodation, flights, transport and any other services forming part of your booking. Please note that most flights are unfortunately non-refundable with the airline so if you cancel your booking it is likely you will still have to pay for your flights
Any cancellation charges imposed by the applicable supplier(s)
Our cancellation administration fee
I’m sorry, but when you’re booking anything expensive on line, it is good practice to check exactly what you’re signing up to first. And that is what you signed up to.

Do the 14 day cancellation rights for remote purchase apply?
I am assuming they don't as no-one else mentioned that already. No doubt someone will confirm why they CCR does not apply.
I just thought I'd mention it as an off-chance.0 -
Pretty sure it doesn’t because of the booked flights being non-refundable.ETA exemptions for

CCR does not apply:
Exemptions There are some contracts where you won’t have a right to cancel a service. For example, hotel bookings, flights, car hire, concerts and other event tickets,
However, can OTB claim the full cost, or only the losses they have/will suffer?0 -
They can't override statutory rights with Ts & Cs but will levy cancellation charges according to their published policy as above - if a customer wanted to challenge those in court on the basis that they're not a reasonable pre-estimate of losses incurred then that's always a possibility, but the key issue with OTAs like this is that non-refundable flights are usually booked, so by their nature those costs can't be recovered, even if making an early decision to cancel....Grumpy_chap said:However, can OTB claim the full cost, or only the losses they have/will suffer?0 -
I have only cancelled a flight at short notice.eskbanker said:non-refundable flights are usually booked, so by their nature those costs can't be recovered, even if making an early decision to cancel....
The amount recovered from travel insurance was remarkably small. The insurer deemed that taxes and passenger charges were not incurred by the airline and should be recovered from the airline. The airline duly repaid those costs.
Does the OP have the ability to recover these elements from the airline?0 -
Theoretically, passengers are allowed to recover the air passenger duty from airlines when not taking flights, but there are usually admin charges levied when refunding these, possibly by both the airline and the agent, so it's unlikely to be economically viable, especially when only charged at £13-26pp for short haul destinations.Grumpy_chap said:

Ah, yes.eskbanker said:especially when only charged at £13-26pp for short haul destinations.
The OP said £3k holiday and £2k cancellation charge. I imagine OTB will say that the APD and such are rolled into the £1k that is not required to be paid.
OP might be best to change mind again and find a way to take the holiday.0 -
Not that it's of any relevance to foreign holidays, I notice that Air Passenger Duty has just been halved for domestic flights.
