I am the keeper of the vehicle and have contacted UKPC and they have turned down my appeal via email, does this mean that they do not have to send a formal notice to keeper within 56 days (?) Please?
    No it means the opposite.

That was the whole point of appealing as keeper on day 26 or thereabouts (and the reasons are fully explained in the NEWBIES thread).

Parking companies and the trade associations that support them are unregulated. That's why they ignore the EA 2010 as well as the DPA 2015 and GDPR 2018 and any other act of parliament or government regulation they fancy.

The only way things will ever change is if people complain to the people in power. It is the only reason why the parking bill was passed, and the only reason why a new mandatory code of conduct will be introduced, but it is flawed.

Whether your complaints will have any effect, I cannot say. I guarantee though that nothing will change if people like us don't complain.

Not sure what you mean.  This is the position you want to be in.  Rejected appeal, never said who was driving and no NTK yet.  As expected!

Slowly time your POPLA appeal...to time them out.

Sorry you are right of course and I will complain to all who you suggest and stop being selfish.

  • I have found the email address of the CEO. Can you check what I have written before I send it please? (I have used some of your comments to write it).....

A PCN was attached to my car by UKPC on the grounds that a Blue Badge was not displayed when the car was parked in a disabled bay in Hall road, Norwich.

I understand that UKPC are your agents and that your company, being the managing agent, is jointly and severally liable for the actions of your agents - including the parking company you allow to operate on your land and this would include any breach of the Equality act (disability discrimination) as your agents have continued to pursue me despite providing evidence of a long-term disability for which a reasonable adjustment must be made.

I have attached a copy of my Blue Badge for your information and I must insist you ensure the parking agent cancel the above PCN on the grounds of disability discrimination.

    Dear Sir,

A PCN was attached to my car by your agents, UKPC, on the grounds that a Blue Badge was not displayed when the car was parked in a disabled bay in Hall Road car park, Norwich.

I understand that As UKPC are your agents and that your company, being the managing agent, is you are jointly and severally liable for the actions of your agents - including the unregulated parking company you allow to operate on your land. I would like to notify you that in the UK, it is a criminal offence to discriminate against someone with a disability in the provision of goods, facilities, and services under the Equality Act 2010 (disability discrimination). and this would include any breach of the Equality act (disability discrimination) as your agents have continued to pursue me despite providing evidence of a long-term disability for which a reasonable adjustment must be made.

Your agents, UKPC, have already been advised of my disability and why a reasonable adjustment should have been made as per the Act. Their refusal to acknowledge their liability does not absolve you of your own, joint liability. I have attached a copy of my Blue Badge for your information and I must insist that you ensure the your parking agent cancel the above PCN on the grounds of disability discrimination.

You are now under notice that any further harassment from your agent, or any third party they engage, will raise this serious matter from inderect to direct discrimination. I remind you that any discrimination under the Equaities Act 2010 is a criminal offence and I urge you to instruct your agents to cancel the PCN with immediate effect.

    Yours faithfully,

Perhaps the above enhancements? I remind you that this is a formal letter so must be started with "Dear Sir" and end with "Yours faithfully".
