You have to show the signs as they appeared on that dark night... illegible and not prominent. PCMUK would love to persuade the a judge that the sign was as visible and prominent as you have shown.

Anyway, it's an IPC member so any appeal to them is useless. Hopefully @Coupon-mad has some ulterior motive for using the photos of the lurking, parking Ninja.

Oh I wouldn't show the clear sign! As you say, it was taken in completely different circumstances.

Yes I might start a thread about this sort of conduct and I might also use it elsewhere!

Unless the driver of that car across two bays was a resident with a (don't really need) permit and someone happened to send that photo to the PPC he/she could receive a PCN! Wouldn't that be fun?

This is the full notice but I'm guessing it's quite a standard one.

So nothing on there about double yellow lines in which case the man on a Clapham omnibus would assume that they mimic what they copy on a highway!

    Hi,

I sent an appeal to PCM after they wrote to me this time and listed all the things I've already mentioned. I've now had a response rejecting my appeal and saying if I pay within 14 days I only 'have to' pay them £60 instead of the original £80/100.
I considered doing this just so they go away and I can stop stressing about it but decided I don't want to give them my hard earned money so I guess it's now a waiting game til they eventually take me to court?
A friend advised me to respond saying 'I don't agree with the charge' and that if I just keep sending that reply they can't apply to the court for a CCJ.
    Is that correct??

Thanks again for your time. I have read through the newbies thread but couldn't find the answer to this question specifically.

    No. That is not correct.

They can't just "apply" to the court for a CCJ. They have to make a Claim through the court and you have to be given the opportunity to see what their claim is and to defend against it. If you follow the advice we give here and study the Newbies/FAQ thread, you will see how we either win or get the claim discontinued in over 99% of cases.

Paying anything to these scammers is making you a part of the problem by funding their scam. If they think they have such a strong case, why do you think they are willing to accept a reduced amount for it to go away? They rely on gullible victims pooping their pants at the mere thought of a court claim who then pay up.

If you've read the forums and the Newbies?FAQ thread, you will by now know that over 99% of the claims advised on that submit robust defences are either won at court or are discontinued before they ever get that far.

Thank you! I was seriously considering paying their reduced amount just so this goes away and I can get on with my life without waiting for a court claim, but you're right and I'm not paying these people anything.

    That's the spirit!

PCM are ex-clampers snd not to be paid:
    http://parking-prankster.blogspot.com/2015/05/is-it-pcm-uk-who-make-up-stuff-all-time.html?m=1

Only problem is, the new statutory Code of Practice still reckons £100 is right for residential car parks so the likes of PCM will carry on regardless, until someone in the end wakes up and realises it's residents and visitors who are being targeted at such locations.

IMHO PPCs need banning from residential sites.

    Good!

How hard did you have to work for your £60 after tax pay?  If you were to pay them, how hard do you think they had to work to snatch your £60?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
