@DisruptiveLad, 99% of court claims advised on and defended robustly on this forum are either won or discontinued before ever getting to court. What we don't do is hold your hand every step of the way. You are advised on what to look out for and where to find the information you need in order to help yourself.
You are obviously struggling to accept that fact. You even reported one of my posts where I gave you a one-line answer about where to find a piece of information you were seeking, as a breach of forum etiquette. You are either a bit thin-skinned or else no longer in need of advice.
So, good luck with your claim. Hopefully, you have learned enough from this forum to give you a fighting chance to avoid becoming a one-percenter.4 -
I don't think anyone is being contradictory.
You are being given information that should allow you to deal with this issue, but you have to decide what route to take.
Is the keeper the best/strongest person to defend a claim, or is the driver?
If the keeper was the driver then it matters not if the NTK was or was not PoFA compliant. If a judge asks the keeper if they were driving, they have to tell the truth.
If the keeper was not the driver and the NTK was PoFA compliant, it matters not since the keeper can be held liable.
If the keeper was not the driver and the NTK was not PoFA compliant, then the keeper cannot be held liable, but would have to understand how to lead a judge by the nose through the PoFA to convince them.
A court claim is on its way at which point the person named on that claim form must defend or pay up.
The only way to stop a court claim is via a landowner/landholder cancellation, or by naming the driver if they are not the keeper.
By doing the latter, it resets the clock whereby the PPC must (should) issue a NTD, and the whole process starts all over again.
You have either been given the information on how to decide what to do, or have been told how to find the information you need to make a decision.
