DCB Legal Letter of Claim

Hello all, just a quick refresh please. My wife's received a Letter of Claim from DCB Legal. Is this the same as a Letter Before Claim? What should this letter contain for it to be legal? Thanks.

    Same, same. Needs to comply with the PaP in some regards, giving 30 days notice and accompanied by some finance forms (which your wife does not complete!).

  • Thanks. Is it supposed to contain the evidence they rely on should it go to court? Should it also state the length of any alleged contravention? Thanks.

    Nope. Those details should come with any court claim form issued (Particulars of Claim), but they are often very generic and wishy-washy catch-all template style. 

    There's a ready made defence template to use, near the top of the forum thread list.

    The NEWBIES thread already tells you that a LBC and LoC is the same thing, and how to respond.

    No it doesn't have to contain or attach that.

    Do not ask for that evidence.

    Let the case go to a claim then use the defence by @Johny86 like you will have read in all other DCBLegal court claim threads this past month.

    Easy stuff!

  • Ive had 2 letters from dcb saying this is a letter of claim in accordance with pre action protocol for debt claims. 

    These are claiming to be from 2017 and 2018 offences of displaying a non valid permit. These are from an nhs hospital where my wife worked and there was a spate of nurses getting these due to untrained staff, they were told to ignore them and heard nothing else until today.

    Are they not out of time even if it was an offence? 

    Should i ignore it again?

    When in 2017? 

    You need to slowly reply to each letter ON THE LAST DAY and ask for some info, then something else, then something else, until it gets past the six year limitation.

    This is NOT @golfnut64uk's thread. You need to start your own thread where you will receive advice. This is the equivalent of talking across someone else's conversation.

  • I yesterday sent a SAR to DCB Legal, but they've already replied saying: "...DCB Legal do not currently hold the documentation in relation to original Parking Charge Notice...If you require information/data or correspondence issued by/sent to a third party, you will need to contact them directly for a Subject Access Request." Does she contact UK Parking Control then?
