Latest update. We have recieved a 'Notice of Allocation to the Small Claims Track (hearing) for next month.
Looks like the claimaint has to pay a £27 trial fee or file a properly completed application 2 weeks before so guess we wont hear much before then but they have been calling us.
We did not answer the phone to them. They have also written asking for us to call them and settle outside court.
Again we have not called them but, as the court document encourages parties to try to settle by negotiation I am wondering if this would mean the judge would be less sympathetic to the defendant if they ignored the claimant?
We will now prepare the evidence and witness statement as per

I have to send my witness statement to the court and claimant by 8th. Should I send these recorded delivery to both the court and claimant?
I know there was a mention on here earlier not to use recorded delivery but I havent seen it said relating to the witness statement so wanted to check as I know how unscrupulous DCB Legal can be.

Ah maybe can use email for both - send to court claimresponses.cnbc@justic.gov.uk and find the right one for DBL (I have it somewhere)0

ThanksYou know that 'the court' is the one to which your case has been allocated, you're no longer dealing with the CNBC (formerly CCBC) now you're at Witness Statement stage.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

The CNBC no longer has any interest in a case once it has been transferred to a hearing court.1 -
Good news day. This morning we received a 'Notice of Discontinuance' from DCB Legal. This was 16 days before the hearing and I was just in the middle of writing the witness statement :-)
Big big thank you to everyone who commented on here for their patience and help and also all those keeping the newbie thread up to date. Great community.
For those in the same boat reading this, follow the great advice, stick to your guns and there is no reason why you shouldn't achieve the same result.5 -

Could I ask you to support this action.
So many people don't receive 1st and/or 2nd pcn but the £170 payment due letter often manages to drop through letter boxes. PPCs always claim discounted/full rate pcns/court claim letters were sent as dated though they offer no evidence to prove this.
Since they CHOOSE NOT to provide evidence of their posting we must continue to press gov to ensure they do and see it included in the new Parking CoP. Please sign/share @jmccabe petition closes 22nd june 2024.
