My response is below. I checked the fees and charges structure and enforcement stages on hceoa’s website. I never received any correspondence regarding added fees, time frames and escalations to different enforcement stages. It’s as if DCB are just completing making it up. It’s just appalling that they try and do this to people.

Would you like me to see if Steve Clark (ex-BPA, now DCB) is prepared to explain this for you?  I am in touch with him and mentioned this added costs fakery to him before.

I'm not stopping you from doing the SRA (DCB Legal) and CIVEA (DCB Ltd) complaints because I think you must. I am adamant that the rules in capped HCEO fees only allow £75 and that's only if the first Enforcement Notice is served (which it wasn't).

Please tell me the two different figures again?

    https://www.hceoa.org.uk/fees-charges/fees-charges-for-recovering-a-debt

This is the page I found, it says it charges a £75 fee on top of the payable amount when the notice is served and if you don’t pay within 7days then it can move to the next stage which is a larger fee add-on plus a percent of the amount you owe. And it keeps going up with each escalation.

My initial court order was for 776.20 and now they want an extra 398.49.

And yes please, can you ask Steve. It just seems like they’ve completely lied to me, claiming that it was passed to a high court enforcement officer (because such thing does exist along with those fees above in that link if a person was to then research it) to scare me into paying this extra £400. Which is basically a scam. Using lies and intimidation to make me pay them more money.

I haven’t received a reply to my last email yet but I am looking forward to hearing what they have to say.

    So am I.

Wanting to know why the HCEO fee list of capped sums somehow doesn't apply to DCB Group.

And why they think they can add anything to the sum ordered by the Judge in your unfortunate absence at the hearing,

When they do, ask them for a copy of:

    - The supposed Writ of Control

    - The supposed Enforcement Notice

because you will be making the complaints to the SRA, CIVEA and if there is a Writ you will be applying to stay the Writ* and drag them back to court to explain themselves.

    * this specific application costs just £14 so will be a cheap way to drag them back before a Judge.

Still no reply from dcb. Maybe this whole nightmare of a situation is finally over. Although I was looking forward to the prospect of dragging them back to court 🥲

But you still have a CCJ because they have refused to tell the court the case is settled.

I am also worried they MIGHT send HCEOs to knock on your door and clamp your car (pursuing the astonishing and I think imaginary 'enforcement fees') if this isn't resolved.

I have an idea (someone interested in helping) and will send you a pm.

Oh gosh, I hope not. I’m literally weeks from having another baby. Please do send me a pm and let me know how you think I should proceed. I was still going to complain to the SRA but the form has to be printed so I was going to find somewhere this weekend to print it out.

I'm on holiday from this weekend, so can only pick this up in a week.

If I were you I'd prioritise ringing the court on Monday and ask:

    - is there a High Court Writ granted in this case, or not?

    and

    - has DCB Legal confirmed that the claim has been paid in full, or not?

If there is a writ I'd apply to STAY THE WRIT for a mere £14 fee, like I advised you last week was possibly a good idea to cover yourself.
