I'm so sorry I dont understand this all.
I am due to attend a court at the end of this month and have received a pack from QDR solicitors on behalf of UKPC. In the information from the court, I have to provide the same to them and the court. It says it is a witness statement and I am trying to lay it out in the same format as them.0 -
This is what I have received from the court:
The following Directions apply to this Claim:
6) Each party must deliver to the other party and to the court office copies of all documents on which that party intends to rely at the hearing no later than fourteen days before the hearing.
7) The original documents must be brought to the hearing.
8) The Judge may refuse to consider a document or take it into account if a copy of it has not been sent to the other party as required by this Order.
9) The documents to be sent to the other party and the court must include the statements of all witnesses (including the parties themselves).
10) Witness statements must: a) Start with the name of the case and the claim number; b) State the full name and address of the witness; c) Set out the witness's evidence clearly in numbered paragraphs on numbered pages; d) End with this paragraph: 'I believe that the facts stated in this witness statement are true.' (or words to that effect); and e) be signed by the witness and dated.

@Fiona1965 are you able to post a copy of the claimant's WS, suitably redacted? Also, are you able to show us your original defence, again, suitably redacted1

Let me try, it may take me a while. I am totally useless with IT, but will take some photos on my phone, redact them and then try and postB789 said:@Fiona1965 are you able to post a copy of the claimant's WS, suitably redacted? @Fiona1965 in the interest of keeping this a bit simpler, can you please make your replies in the current thread that has the background information on your case. I understand the original thread from 2019 is now closed for some reason but having 4 threads on the same case is just not acceptable.Fiona1965 said:

Here is the link to the thread. Please, ONLY use that thread for future reference.:

A witness statement is a narrative (story) of what happened on the day and subsequently, it should back up and support what you wrote in your defence. The defence you have shown us recently actually reads more like a WS, just change "the defendant" to "I" and provide evidence that bolsters your defence.1

Are you saying that’s not the case?1 -
Yep for your WS ‘I’ not ‘Defendant’, theirs is different as the claimant is a PPC not an actual person or human being.2

I’ve sent it. I just hope it’s ok. I didn’t know a defence was a formal thing so I just put some notes in the box that I completed online through the money claim page. I’ve done my WS as per one of the templates on here so I hope my lack of defence statement doesn’t let me down.0

Well, you've done your best despite a (probably) weak defence, so just attend the hearing with a copy of your WS and evidence and a copy of theirs - and good luck!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
