UKPC

I urgently need to send a witness statement as my court case is pending. I have just received the claimants one and it looks so professional but im
not sure what to do. I live no where near where the fine was issued so cannot go back and take photos etc. 

is there a template I should use? I have looked at some on here but they don’t seem to apply, or perhaps I don’t understand them?

I’ve been told Contestor Legal are an easy way to do it. 

Any help would be so gratefully received.

    I’ve been told Contestor Legal are an easy way to do it. 
    You don't need to pay them!

    Could you please point me in the direction to those bundles. I’m afraid I’m not very good at this and due to a mental health disability am finding this very difficult

    Just click on the user's name which will take you to their profile page. Click on 'Discussions', then scroll down the page to the Discussion Thread relating to their parking charge and subsequent WS. In the case of @aphex007, keep going through the whole thread, to understand the context, where you will find v3. V1 and v2 should not be used.

    would someone, if they have the time, please check what I have written so far?

    1. The parking charges referred to in this claim did not arise from any agreement of terms. The charge and the claim was an unexpected shock. The Defendant denies that the Claimant is entitled to relief in the sum claimed, or at all.  It is denied that any conduct by the driver was a breach of any prominent term.

     

    The facts as known to the Defendant:

    2. It is admitted that the Defendant was the registered keeper of the vehicle in question.

     

    3. The defendant was visiting her daughter in November 2019, which had been a regular occurrence on numerous occasions. She admits that on the 16th November 2019, that she was parked in a visitors bay in the car park belonging to the flats her daughter resides in. On every occasion that the defendant parked in this car park she was displaying a permit, issued by the letting agent.

    The defendant was displaying two permits in her windscreen; one for her workplace of XXXXXXXX and the other being the permit issued by the letting agent, as shown in the claimants photographs.

    The defendant was parked in all good faith, showing a permit that had been issued by the letting agent.  The tenant, the defendants daughter, was not issued with a parking lease or contract within her tenancy agreement.  Residents have underground, secured parking in a locked area, only accessible to residents and therefore only visitors require the use of a permit.

    The claimant displays three notices within the car park.  One would not apply to the defendant as it is placed on the block of flats, not leased by the defendant’s daughter, but another block of flats with parking on the other side of the car park.  This is some distance from the visitors parking spaces, occupied by the defendant.  One of the other signs is above the residents secures underground parking area; again, not observed by the defendant as she would not be able to access the secured resident’s car park.  The third sign is placed on a wall, in a corner, partially obscured by a tree and not visible as entering the car park.  As it was a night in November none of these signs would have been clearly visible and they do not have their own lighting.  There is only one light in the car park, which is extremely dim, due to it being outside resident’s windows.

    In the claimants witness statement they bring other cases into account.  The template that I am using, from the examples I have been direct to on this page, also talk about Beavis and others.  I'm not sure whether I should be including these and the claimant has used them, therefore it would suggest they are anticipating me using them?  I do not understand any of the jargon the claimant is using in their witness statement
