The MCOL history shows that the Claimant filed their DQ on 12th June last year, the same day it was sent to my friend.Coupon-mad said:I suspect the Claimant was also held to have failed to send a DQ. So the case is stayed at the moment in case they do.

How strange then that it is marked 'stayed' again and wasn't updated yesterday to show the D's DQ was received!

My friend received this today, I'm lost for words how incapable they are. I assume it's a case of ringing them again to try and explain, again, that the DQ was filed on time and that we have proof of it.
Is there anything else I need to get my friend to do or say?

Tell the Defendant to read the thread by @jag_run which shows who to complain to at the CNBC - that poster got at least £150 compensation for the mess up in that case.Oakley2702 said:My friend received this today, I'm lost for words how incapable they are. I wish the D had spoken to the CNBC two weeks ago to pre-empt this, as I advised. Could see this coming and the D needed to stop it BEFORE the defence was struck out.

Thank you. Just to confirm, the Defendant did email CNBC with proof of DQ originally being sent, this was done on 23rd January, they followed it up two days after with a phone call to confirm receipt of the email and the purpose of the email. D was told it would be dealt with, I guess something was lost in translation. They will be ringing again in the morning.Coupon-mad said:

After speaking with the CNBC today, my friend was told that sending screenshots of the email was not proof enough, even though he was explicitly told that was how to do it. Therefore, he is now forwarding the email in question with proof that the auto-reply was received too.
This is all just getting ridiculous now.1 -

It means the court has accepted the defence and it is now up to the claimant to decide whether they wish to proceed with their claim. No doubt they will. You will then receive a Directions Questionnaire from the court which you will need to respond to.2
