  • Spent over 70 minutes on hold today to Northampton CC without any luck - trying to see if I can get some clarification on what's happening.

    Is it likely that, as I'm assuming, it's been stayed as they (for some reason) haven't received the DQ response?

    Defence struck out is VERY alarming.

    The Defendant (YOUR FRIEND, NOT YOU) needs to call the CNBC first thing at 8.30am and complain that they sent the DQ twice and have proof from both the Claimant's solicitors and the CNBC (emails acknowledging the DQ received from both recipients).

    The CNBC have mucked this up but it sounds like both DQs went missing.  This is not OK.

    DO NOT GIVE UP. 

    Do not do nothing. It hasn't gone away.

    They (NOT YOU, IF YOU ARE NOT THE DEFENDANT) must call at 8.30 am and then stay on the line. Have the phone on loudspeaker and stay near it.

    Can take 1.5 hours to be answered.

    Thank you. I'll get them to do that, I've got them to double check the received emails and the DQ he sent in September had the auto reply response one minute after sending from CCBC, so it was definitely received and also by DCB legal on the same day. 

    When you say CNBC, I assume you mean the Northampton County Court? I don't think I've seen that abbreviation before so just want to double check.

    CNBC = Civil National Business Centre, which happens to be in Northampton.

    Northampton County Court is also in Northampton but an entirely different establishment.

    Ah okay, thank you for clarifying that. I will make sure they ring them in the morning. 
  • My friend has spoken with them today and has now sent off the proof of the DQ being sent and received. He also got the auto reply today so have confirmation about that too. 

    Hopefully things can get back on track now.

    What does this mean exactly?
    From search engine: A stay involves halting the whole or any part of proceedings, generally to allow time for something to happen. It is ordered following an application by a party or the court acting on its own initiative. A stay can be lifted, allowing proceedings to continue.

    In terms of this case, I'm hoping it means it's because the DQ is now being filed correctly.

    I suspect the Claimant was also held to have failed to send a DQ.  So the case is stayed at the moment in case they do.
